Juicio político a Donald Trump: la defensa apelará a la libertad de expresión

Tras el asalto al Capitolio hace dos semanas, Donald Trump fue acusado por el ala demócrata por «incitar a la insurrección». En un escrito de 80 páginas, sostienen que los dichos del exmandatario en su mitin del 6 de enero fueron el leit motiv que llevó a sus seguidores radicalizados a entrar en el Capitolio.

La defensa presentó recientemente un escrito de 14 páginas, que no presenta dichos acerca del polémico resultado electoral. No obstante, si desestima muchos dichos del neoyorquino como desencadenantes de la violencia. Para Trump y sus abogados, sus frases representan un ejercicio de libertad de expresión amparada constitucionalmente. Con ese argumento como «gancho», afirman que no corresponde elevar la demanda a juicio político, sumado al hecho de que ya se encuentra fuera del cargo.

Desde la vereda demócrata creen que el material videográfico es prueba concluyente de que el lenguaje de Trump fue usado calculadamente para incitar a la violencia. Con frases como “Nunca recuperaréis vuestro país con debilidad”, “Tenéis que demostrar fuerza” o “Luchar como el demonio”, para los acusantes ese último mitin fue la chispa que encendió los problemas en el Capitolio.

Las expectativas de cara al impeachment no resultan esperanzadoras: Trump ya tiene experiencia en el juicio político y para su condena deben votarlo culpable dos tercios del parlamento, y difícilmente los republicanos sentencien a su exponente más paradigmático. En caso de una condena efectiva, Donald Trump quedará inhabilitado para ejercer roles políticos.
