La pandemia mostró el peor rostro de nuestra clase gobernante

Si hay algo que caracteriza a la democracia, a diferencia de otras formas de gobierno, es que el foco está puesto en el ciudadano y los derechos que este obtiene como tal. Esos derechos están organizados en una carta, la constitución, y tienen como característica ser inalienables e imprescriptibles. Esto quiere decir, lisa y llanamente que ningún gobernante puede arrogarse la anulación de los mismos, o al menos con ese espíritu se hicieron nuestras modernas constituciones occidentales.

Protegernos del estado, y de las arbitrariedades de los gobernantes es el sentido último de las cartas magnas que se hicieron al calor de la Revolución Francesa, y que, en cada país, si bien se fueron reformando, mantuvieron este eje como principio rector en sus fundamentos. O al menos esto solía ser así. De hecho, para “suspender” cualquier derecho o garantía que otorga la constitución solo puede hacerse mediante el congreso, y en situaciones excepcionales que pongan en riesgo a la propia república, algo que viene ya desde la cultura republicana latina. Pero bajo ningún concepto puede atribuirse esta posibilidad a la arbitrariedad de un funcionario político, sea este gobernador o presidente.

Por eso sorprende como se han viciado los derechos civiles en Argentina, donde el caso Insfrán es tan sólo uno entre tantos. Durante la cuarentena, todo el sistema político se vio amenazado no sólo por una suspensión de nuestra constitución, sin ningún tipo de legitimidad de los representantes civiles en el congreso, sino que hemos retrocedido a los tiempos de la colonia, en dónde cada territorio decidía por sí mismo las formas de circulación de las personas entre cada uno de ellos. Y esto ante la mirada pasiva de un ejecutivo nacional que nada hacía por remediar la situación, sino que se desentendía del problema, alentando el «dejar pasar, dejar hacer».

Hemos visto barreras internas en las provincias, o en los municipios sin ningún tipo de sustento de política sanitaria sobre el aislamiento, sino basadas en una especie de capricho que se le ocurría al gobernante local para mostrar “que hacía algo” a sus conciudadanos, pero ese hacer algo significó, en la práctica, anular los pactos preexistentes que nos conformaron como nación. Y esto es sólo uno de tantos ejemplos de cómo las provincias o los municipios, utilizaron la cuestión de la pandemia como excusa para violar las libertades individuales y los pactos constitutivos de nuestra patria.

Todos nos hemos conmovido con el caso de la chica que falleció en Córdoba en un hospital, Solange, a cuyo padre no dejaron ni entrar a despedirla, o también el caso del padre que cruzó en brazos a su hija en Santiago del Estero para llevarla a realizar un tratamiento contra el cáncer. Por eso no sorprende lo de Formosa, porque la república está viciada de excesos de abuso de autoridad y conculcación de derechos, y por más autoridad o autonomía que tenga una provincia, eso no quiere decir que este por arriba o que pueda ir en contra de los derechos y garantías de nuestra Constitución, que está por encima de cualquier decisión que puedan tomar los distintos niveles gubernamentales.

Esto no es una cuestión de discusión filosófica o mora, es una realidad plasmada en nuestra propia constitución, en dónde los derechos individuales están por arriba de cualquier decisión estatal, sea del nivel que sea. Por eso sorprende la postura de los organismos de Derechos Humanos, que han guardado un silencio insoportable frente a los abusos de gobiernos que lentamente se van convirtiendo en autoritarios, y van en contra de los derechos básicos que, como plenos ciudadanos de una comunidad, nos fueron otorgados por la carta magna.

Argentina supo ser un ejemplo en la defensa de los Derechos Humanos, y sus organismos recibieron el reconocimiento y el apoyo externo para continuar su lucha. Pero hace ya unas décadas que esos mismos organismos parecieran haberse partidizado, y responder más a posiciones ideológicas que a los fundamentos mismos que los crearon, con lo cual, la sensación es que los derechos de las personas importan sólo si pertenecen a tal arco político, de lo contrario son negados o ignorados.

La pandemia entre las cosas que se ha llevado es la credibilidad de estos organismos, y ha puesto el foco en la necesidad de los ciudadanos de no contar con más mediatizadores que “aboguen” por nuestras libertades. Así empezaron a alzarse voces, tanto en Formosa como en otras provincias, y aunque en muchos casos han sido acalladas con violencia, lentamente una sociedad que esta aturdida por el miedo a un virus, empieza a despertar y ver la triste realidad. Estamos a merced de una banda de dictadores.

La responsabilidad es sólo nuestra, porque el congreso, es decir, nuestros representantes, salvo contadas excepciones, miran para otro lado, y convalidan partidariamente lo que sale desde las usinas del poder. Romper este esquema, en democracia solo puede hacerse a través del voto, y la voz de los que hoy están sufriendo estos atropellos, así como la de todos, que vemos como se llevan puesta la república, debe hacerse oír con fuerza en octubre.

Si pretendemos seguir viviendo en una república, la tiranía tiene que acabar y la responsabilidad se encuentra en nuestras manos. Estamos a tiempo, debemos combinar el enojo con la acción y defender algo que nos pertenece por nacimiento y por derecho que son nuestras libertades, ningún estado, por más autónomo que sea puede pisotearlas, y hay que defenderlas con uñas y dientes, de lo contrario, nos encontraremos, más temprano que tarde, sujetos y encadenados a un tiranía que de sanitaria no tiene nada.
