Editorial: El avasallamiento a la democracia
El kirchnerismo busca el juicio político a la Corte Suprema
Hoy es noticia en todos los medios la postura de Massa, jefe de la cámara de diputados, en donde el político reconoce que si bien hay críticas, no “podemos hablar livianamente de juicio político a los miembros de la Corte porque es uno de los poderes del Estado”.
Pero la cautela que muestra el presidente la cámara de diputados no parece ir en consonancia con lo que piensan y dicen varios referentes de la coalición gobernante. Desde actores, dirigentes sociales y políticos ligados directamente a la vicepresidente, vienen desde hace meses promoviendo el juicio político a los miembros de la corte para, desembozadamente, sugerir que hay que poner jueces que sirvan para la causa, porque el resto solo pone palos en la rueda.
Estos mismos referentes parecieran desconocer que vivimos en un país que abraza los ideales de la democracia, y que cómo tal, la división de poderes es una de sus marcas fundamentales, garantizadas en nuestra Carta Magna. Por eso, los ataques a la Corte no son cuestiones menores, hacen a nuestra propia esencia como país.
El kirchnerismo parece olvidar estas cuestiones en pos de resolver las necesidades particulares de Cristina y de los aliados procesados por causas de corrupción como es el caso de Boudou o De Vido. Y cómo no les gustan los fallos judiciales pretenden una corte que convalide las intervenciones para ajustar las decisiones legales a sus propios intereses. De ahí el desarrollo de la teoría del “lawfare”, que no es ni más ni menos que la disconformidad con la justicia.
Cristina es hábil, eso hay que reconocérselo. Ante la avanzada judicial desplegó una disputa ideológica que sólo existe en su cabeza, pero que ha logrado articular como política. El lawfare es la forma que el kirchnerismo asumió para transformarse de victimarios en víctimas.
Además, el lawfare es la excusa perfecta, la mejor prueba, para intervenir la justicia, porque si la justicia ha dejado de juzgar, para convertirse en un partido político, según la teoría que despliega el Instituto Patria, nada mejor que avanzar sobre ella, porque está “deslegitimada”, y nunca fue sometida al voto.
Aún el propio Alberto parece haber caído en la trampa que propone el kirchnerato, de fustigar a la corte como si fueran usurpadores, y por lo tanto un poder que hay que remover. Durante el fin de semana, en una entrevista, Alberto señalo que le “da impotencia porque es un poder autónomo en la República”, señalamiento que, en boca de un presidente, puede resultar peligroso. Más aún, cuando sabemos que el kirchnerismo cuenta con un ejército de trolls que se encargan no sólo de repetir las consignas de la “jefa”, sino de demoler a cualquier opositor con marchas, escraches, y cuanta táctica antidemocrática uno pueda imaginar.
Por eso, los dichos de Massa, aunque poco creíbles, traen un poco de tranquilidad. La política no puede llevarse puesta a la justicia, más allá de lo que necesite uno de los dirigentes más importantes de la actualidad como lo es la vicepresidente. Los intereses particulares de los políticos no pueden teñir nuestras decisiones institucionales, y eso le kirchnerismo no parece entenderlo, porque se halla inmerso en un personalismo que no reconoce matices.
Más allá de la pertenencia política de cada uno, defender los poderes de la democracia es la tarea de todos los ciudadanos. El embate contra la Corte Suprema no puede traer otra cosa más que enfrentamientos, quizás uno más entre los tantos que viene encarando el gobierno. Los frentes abiertos son muchos, la disputa con la ciudad por las clases, el enfrentamiento con el campo por las retenciones, y ahora la justicia. Pareciera que en lo único que piensan es en perder, porque están dando todos los pasos para ganarse el repudio de una gran parte de la sociedad argentina.
