Mario Otero: el periodista que denunció al gobierno provincial

Hace dos semanas el periodista, cabeza del programa «Nada Secreto» en Radio Universidad, presentó un ante la Comisión Interamericana de Derechos Humanos -CIDH- una denuncia. En la misma, explica que actualmente es víctima de un bloqueo informativo de parte de las autoridades provinciales, lo que supone una violación a los derechos humanos.

Otero, quien se desempeña como docente en la Universidad Nacional de San Luis, manifestó que desde los órganos de gobierno no atienden sus llamadas. Por lo tanto, considera que se ve afectado su ejercicio profesional, al no poder recabar información gubernamental.

El abogado de Otero, Cesar Francisco Guiñazú, conversó con La Voz Puntana y brindó algunos detalles de denuncia que llevan adelante. Según el abogado, el objetivo es lograr que desde el Estado Argentino y provincial se le asegure al denunciante la libertad de expresión y pensamiento.

Guiñazú mencionó la existencia de ciertos derechos fundamentales: el derecho a la búsqueda de información y el derecho a recibir la información de funcionarios y órganos de gobierno. Asimismo, también agregó el derecho a divulgar libremente la información recabada. El jurista sostuvo que le es imposible a su cliente contactarse con cualquier funcionario de la provincia, atentando contra los derechos previamente mencionados.

El mecanismo

En su denuncia, Otero habla de un «Mecanismo de censura» desde la provincia. Al consultarle, Guiñazú explicó que dicha modalidad gubernamental se agudizó desde el comienzo de la pandemia. Según explicó el abogado, su cliente no recibe respuestas de parte del ejecutivo provincial.

En este sentido, el abogado expresó: «Considero que bajo ningún aspecto puede resentirse la información pública porque si se resiente, lo que sufre es el sistema democrático». Admitió que la situación es común en muchos países de la región, y supone una violación al Artículo 13 de la Convención Americana de los Derechos Humanos, que enlaza de forma inescindible el derecho a la información con el estado de derecho y la democracia.

Además, avisó que si la provincia no responde a las recomendaciones de la Comisión Interamericana de Derechos Humanos, este organismo podría denunciar los hechos a la Corte Interamericana. En ese punto, la Corte resolvería con carácter imperativo el cumplimiento de los derechos que considere vulnerados.

La investigación

Francisco Guiñazú contó que la denuncia ya fue acogida por la Comisión Interamericana de Derechos Humanos -CIDH-, y se espera que el organismo inicie una investigación propia en un tiempo. Por la cantidad de casos en los que trabajan, desde la CIDH les pidieron que sean pacientes.

Sin embargo, Otero y su representante ya adjuntaron documentación recaudatoria, que será evaluada por la CIDH.

Colegas solidarios

Algunos colegas de Mario Otero se hicieron presentes para acompañar su denuncia. Entre ellos, destacó la participación del Foro de Periodismo Argentino -FOPEA-. Uno de los miembros de FOPEA, Pablo Oro, se ofreció como testigo y seguramente declare. Guiñazú señaló que Otero tuvo contacto previo con ellos y les informó de la situación. Desde FOPEA asumieron total solidaridad con él, ya que su postura respecto a lo que ocurre en San Luis es consecuente desde hace tiempo.

El abogado también se mostró sorprendido por la repercusión que tuvo el caso, ya que colegas de toda la región cuyana se contactaron con ellos.

Sin embargo, consideró que el obstáculo para que estos planteos se hagan efectivos son las asimetrías de poder entre las partes. «El poder está tan concentrado que se hace impermeable a las críticas de estos organismos, que tienen prestigio internacional», sostuvo.
