Una fiscal pidió revisar la condena a un sacerdote condenado por abuso sexual
Se trata de Agustín Rosa Torino, de 67 años. La condena fue menor a la solicitada por la fiscal del caso.
12 años de prisión para Agustín Rosa Torino. El sacerdote salteño de 67 años había sido sentenciado tras cometer abuso sexual gravemente ultrajante agravado. Sin embargo, la fiscal Verónica Simesen de Bielke había solicitado 10 años más para el ministro religioso. Para la fiscal, la justicia cometió vicios en la dosificación de la pena, que se apegó al mínimo legal para estos casos.
La investigación reveló que el sacerdote cometió abusos con 3 víctimas: con todas mantenía relaciones personales, un agravante a la hora de recibir condena. Las acciones y los métodos del abusador también fueron llamados a tener en cuenta por Simesen de Bielke, ya que considera que han causado un gravamen irreparable a las víctimas: las secuelas son el daño físico y psíquico grave, sumado al menoscabo moral y espiritual causado a las víctimas.
Para la fiscal «es deber de la judicatura adecuar la pena a los hechos probados». Otro de los agravantes del caso reside en que Rosa Torino era fundador y superior de un reconocido instituto religioso, con sedes en el país y en el extranjero. Para la jurista el abusador utilizó ese estatus para vulnerar la libertad e intimidad sexual de sus víctimas. La acusación es tajante: considera que el sacerdote aprovechó su posición en el instituto como medio para perpetrar sus abusos.
Por su parte, en la justicia ya recibieron el recurso de casación de la fiscal Simesen de Bielke. En Tribunales consideran que el sacerdote fue el autor material del delito «abuso sexual gravemente ultrajante agravado por ser ministro de culto reconocido en perjuicio de dos víctimas y abuso sexual simple agravado por ser ministro de culto reconocido, en perjuicio de otra». Sin embargo, se busca conocer por qué decidieron rebajar 10 años la pena.
