El pedido provino de Luis Petri, diputado nacional. Las mismas habían sido removidas tras comprobarse que son potencialmente letales.

Las pistolas son producidas por Taser, una firma con sede en Texas, EE.UU.

El diputado nacional Luis Petri, miembro de la UCR, presentó un proyecto de ley para autorizar y regular el uso de Pistolas Taser en fuerzas policiales y de seguridad de todo el país. Aunque las Taser no son armas de fuego, su no letalidad quedó en medio de la polémica cuando se conoció que en realidad si pueden causar la muerte. La iniciativa de Petri, que tuvo apoyo de algunos legisladores, busca determinar en que condiciones y circunstancias pueden ser accionadas las pistolas, uniformando las reglas de uso.

En la presentación del proyecto, Petri expresó: «Tanto las Fuerzas Federales, como las provinciales, deben estar dotadas de pistolas Taser, capacitado el personal policial y establecidos los protocolos para su correcto funcionamiento. No hay excusas para que ello no suceda”.

Las Taser fueron reglamentadas por el Poder Ejecutivo en 2019, aunque Petri admitió que en aquel momento las normas de uso eran controversiales. Por eso el radical sostuvo: “Nuestra iniciativa recepta la buena reglamentación dictada por el Poder Ejecutivo en el año 2019, pero además dispone, a fin de eliminar cualquier tipo de controversia respecto de las mismas, que sólo deberán utilizarse exclusivamente en situaciones en que hubiera estado justificado el empleo de una fuerza mayor o letal y siempre que no produjere un daño excesivamente superior al que se quiere hacer cesar».

El uso de dichas armas estaría prohibido contra personas vulnerables -niños, mujeres embarazadas o ancianos- y en casos no aconsejables por el «criterio científico». Asimismo, el proyecto de Petri “impone al Ministerio de Seguridad el deber de elaborar un informe anual, con la evaluación y el seguimiento respecto del uso de armas no letales por parte de las fuerzas policiales y de Seguridad Nacional».

Un instrumento polémico

Las Taser fueron reglamentadas en 2019 por la Ministra de Seguridad de entonces, Patricia Bullrich. Fueron propuestas como una «alternativa intermedia que, de manera proporcional y racional, sea idónea para repeler una agresión, defender la vida de terceros o evitar la comisión de un delito”. Sin embargo, la proporcionalidad y racionalidad de uso fueron los aspectos controversiales de la propuesta, ya que un uso indebido o exagerado puede provocar la muerte.

Según un informe del Centro de Estudios Legales y Sociales -CELS-, en los Estados Unidos más de mil personas murieron por el uso de estas armas, durante los años 2000 y 2007. Aunque se proponen como una alternativa intermedia, la guía de usuario de las Taser confirma los daños severos que puede causar a la salud de quienes reciban un disparo.

La misma guía versa que someter a una persona a 15 segundos de descargas replica el efecto físico de un estrangulamiento, y advierte que esos efectos psicológicos y metabólicos “aumentan el riesgo de morir o de un daño severo”.
