Un hombre condenado a 12 años de prisión por abusar sexualmente de su hija
Los abusos fueron denunciados en 2019 por la madre de la víctima, vecina de Villa Mercedes. Lo procesaron por el delito «Abuso sexual con acceso carnal agravado por el vínculo y la situación de convivencia preexistente de su hija biológica».
«Abuso sexual con acceso carnal agravado por el vínculo y la situación de convivencia preexistente de su hija biológica» es el delito por el que un hombre, vecino de Villa Mercedes, fue condenado a 12 años de prisión. Fue denunciado en 2019 por la madre de la menor y sentenciado en la Cámara Penal N°1 de la provincia.
Para el caso la defensora de Menores, Yésica Agüero, solicitó que se incorpore la perspectiva de género y la consideración de la protección integral de los derechos de niños, niñas y adolescentes. «En este caso, los niños y niñas no tienen la posibilidad de elegir, no entienden lo que les pasa, tienen miedo de hablar acerca de las agresiones sexuales”, manifestó Agüero.
La misma defensora relató como la niña confesó los abusos padecidos a su madre, y explicó de manera pormenorizada los ultrajes que le ocasionó su padre. Asimismo, mostró las evidencias recolectadas en la causa: la menor pasó por Cámara Gesell y el informe confirmó que se trata de un relato “coherente, totalmente creíble y con estructura lógica”.
En los alegatos, Agüero negó que la menor haya prestado consentimiento. Tras enumerar los daños físicos y mentales que le ocasionaron los abusos a la víctima, remarcó que los ultrajes ocurrieron en numerosas ocasiones y fueron creciendo en complejidad.
Néstor Lucero, fiscal de Cámara, solicitó una pena de 15 años para el abusador. Se refirió al grado de perversión e irresponsabilidad del hombre: para Lucero el hombre manipulaba a su hija y la trataba como un objeto. Por el contrario, Pascual Celdrán, abogado del imputado, cuestionó la validez de los procedimientos y solicitó la absolución del imputado por el beneficio de la duda.
