NOVEDADES EN EL CASO MÓNICA RAMOS
Revisaron la prisión preventiva del único imputado por el crimen. El tratamiento del pedido estará a cargo del Tribunal de Impugnaciones y se desarrolló en la Sala Oral del segundo piso del edificio de Tribunales.
Este martes, desde las 9:00, se realizó una audiencia de revisión de prisión preventiva solicitada por la defensa de Federico Núñez, único imputado por el homicidio de la docente Mónica Ramos, y detenido en el Servicio Penitenciario Provincial desde marzo del 2020.
Los jueces a cargo serán Jorge Sabaini Zapata, como presidente; Hugo Saa Petrino y José Luis Flores, como vocales. En la audiencia de mañana las partes (integradas por los abogados y la Fiscalía de Impugnación), deberán exponer oralmente y en un tiempo predeterminado, sobre el pedido concreto que van a elevar a los jueces. Luego, el tribunal se retirará a deliberar.
La defensa de Núñez pidió que se disponga la libertad de su cliente durante el tiempo que demande la reunión del material probatorio requerido por la Fiscalía de Juicio y los abogados de la familia. Además, argumentaron que el imputado no tiene antecedentes penales, posee arraigo familiar en esta ciudad y no obstaculizaría la investigación judicial.
Es la tercera audiencia que se fija en este caso. El 1° de junio el Tribunal de Impugnaciones debía resolver un pedido de cese de prisión preventiva para Núñez solicitado por sus abogados. Sin embargo, la misma defensa presentó unas horas antes una recusación contra Sabaini, Saa Petrino y Flores, y la fiscal Virginia Palacios, porque entendían que los jueces ya habían rechazado una solicitud de libertad cuando conformaban la ex Cámara Penal N° 1, actual Cámara Residual.
Esa recusación fue rechazada y se ordenó que el mismo tribunal interviniera para llevar adelante la audiencia de revisión de prisión preventiva de Héctor Federico Núñez. Se fijó una segunda audiencia para el 13 de junio, pero luego se declaró desierta debido a la ausencia injustificada de la defensa del imputado.
Núñez, de 32 años, está imputado por el delito de “homicidio criminis causa en concurso real con robo calificado por escalamiento e incendio”, y enfrenta un pedido de condena de prisión perpetua por parte de la Fiscalía de Instrucción. El hecho ocurrió el 3 de marzo de 2020 en la casa de la profesora, ubicada en la calle Belgrano al 100. El juicio en el que se investigará la muerte de Ramos se realizará del 3 al 14 de octubre de este año.
¿Qué son los tribunales de impugnación?
Estos tribunales fueron creados con la Reforma Procesal Penal y tienen como objetivo reducir los tiempos para expedirse sobre las refutaciones interpuestas por las partes. Este tipo de trámites recaían antes en las Cámaras de Apelaciones en lo Penal y podían demandar entre 30 y 60 días hábiles en resolverse. Ahora, esos plazos se reducen a una audiencia oral y pública o hasta 10 días hábiles para causas más complejas.
En la Provincia funcionan dos Tribunales de Impugnación. Uno con competencia en la Primera Circunscripción y el otro con competencia en la Segunda y Tercera Circunscripción. Cada uno está conformado por tres jueces.
Los integrantes del Tribunal deben elegir, anualmente, un miembro como presidente quien deberá ejercer la representación protocolar del órgano ante el Superior Tribunal de Justicia y demás organismos estatales y no estatales.
