La Corte Suprema de Justicia dejó sin efecto la sentencia del fuero puntano contra el periodista Diego Masci por el video de la ex ministra de Educación Natalia Spinuzza donde ésta admitía que estaba fumando marihuana y consumiendo alcohol.

La justicia de San Luis condenó a Masci a pagar una multa de $90 mil por la «comisión del delito de publicación indebida de una comunicación electrónica» (art. 155 Código Penal), aduciendo que el periodista había violado la intimidad de la funcionaria pública.

En sí, la multa no es significativa en lo económico en cambio, el fallo de la justicia local fue un claro mensaje para la prensa puntana que puede sentirse amordazada de investigar y difundir información de interés publico.

El video fue filmado en Amsterdam, Holanda, mientras la exministra se encontraba de licencia con su pareja y ellos mismos lo compartieron en un grupo de familiares y amigos. Meses después el video se filtró, circuló entre periodistas y se viralizó por las redes. El portal ZBol, propiedad de Diego Masci, lo publicó al igual que lo hicieron otros medios locales y nacionales.

Spinuzza demandó a Masci y ganó en una primera instancia, fallo que obviamente fue ratificado por el Superior Tribunal de Justicia que consideraron que el comunicador había violado de derecho a la intimidad y privacidad de la funcionaria.

Así fue que la defensa del periodista recurrió a la Corte Suprema de Justicia desde donde, tras estudiar el expediente, el Procurador General de la Nación argumentó a favor de la libertad de expresión teniendo en cuenta que el video exponía el comportamiento de una funcionaria pública y que: “en una sociedad democrática los funcionarios públicos están más expuestos al escrutinio y a la crítica del público” y que por tanto su exposición no se limitan a lo concerniente “a los actos realizados por funcionarios públicos en el desempeño de sus labores”, sino también, “entre otras”, a las que refieren “a la idoneidad de una persona para el desempeño de un cargo público”.

Además, el Procurador recuerda que fue la propia Spinuzza la que tomó el video y lo hizo circular entre un grupo

acotado de personas, probablemente sin la autorización explícita de darlo a conocer más allá de ese círculo.

Finalmente, y basado en toda la argumentación del Procurador Nacional, la CSJ «deja sin efecto la sentencia apelada. Remítase para su agregación a los autos principales y para que, por quien corresponda, se dicte un nuevo pronunciamiento con arreglo a lo expuesto».
