CASO GATICA: PRISIÓN PREVENTIVA PARA DOS IMPUTADOS

Fue lo dispuesto por el Juez interviniente en la audiencia de formulación de cargos. Quedan en espera de resolución la situación procesal de 3 imputados más en virtud de la prórroga solicitada por la defensa, para quienes el Ministerio Público Fiscal también solicitó medidas privativas de libertad.

Este martes, el Juez de Garantías Nº 3 de San Luis, Marcos Flores Leyes, resolvió la situación de dos de los seis imputados por el caso del homicidio del policía Diego Gatica. El magistrado dictó la prisión preventiva por el plazo de 60 días para dos mayores de edad, reduciendo el plazo solicitado por el Ministerio Público Fiscal, que fue de 120 días.

Asimismo, hizo lugar a la prórroga de 8 días para un mayor de edad -quien permanecerá detenido-, a solicitud de sus abogados defensores; y difirió la resolución de la situación de dos menores de edad por el mismo plazo. También prohibió a otro menor de edad, el consumo de cualquier bebida alcohólica y/o estupefacientes por el lapso de 4 meses.

Respecto al seguimiento de un posible tratamiento médico -y en base a lo peticionado por la defensa y el Defensor de Niñez y Adolescencia Nº 1 de la Primera Circunscripción Judicial-, el Juez pidió que se oficie al Centro de Prevención y Asistencia de las Adicciones (CPAA) del Hospital de Salud Mental para analizar si el menor necesita dicho tratamiento.

El hecho que se investiga ocurrió el pasado 5 de septiembre cuando el efectivo policial Diego Gatica fue asaltado y golpeado brutalmente por 6 jóvenes a la altura del puente del Barrio Tibiletti, de la ciudad de San Luis. Gatica, quien prestaba servicios en la División de Respuesta Inmediata Motorizada (DRIM), estuvo internado durante seis días en el Hospital Central “Ramón Carrillo” hasta su fallecimiento, el 11 de septiembre de 2022.

La audiencia se llevó a cabo en la Sala de Oralidad Nº 2 y además del Juez interviniente, actuaron como Fiscal de Instrucción Nº 4, María del Valle Durán acompañada por los Fiscales Adjuntos Claudia Patricia Heit, María Fernanda del Cerro y Fernando Andrés Salas.

Por parte de la Defensa actuaron los Defensores Oficiales en lo Penal, Carlos Salazar, Nadia Agúndez y Matías Farinazzo Tempestini; el Defensor de Niñez, Adolescencia e Incapaces N° 1, Sebastián Privitera, y los defensores particulares María de los Ángeles De Pasquale y García Garro. Como Secretaria del Juzgado intervino Cintia Paola Martín.

SOBRE LA AUDIENCIA DE FORMULACIÓN DE CARGOS

Se trata de una de las audiencias de las primeras etapas del proceso penal establecida en el Artículo 110 del Código Procesal Penal de San Luis.

Esta instancia se realiza con el propósito de que se le informe a un/a imputado/a los hechos delictivos que se le atribuyen. Se hace de manera oral, con la presencia de todas las partes (fiscales y defensores). Para la imputación de cargos, debe existir un grado de sospecha por parte del Ministerio Público Fiscal, de acuerdo a las evidencias recolectadas que advierten la comisión del hecho. En la audiencia de formulación de cargos se describe el hecho, la evidencia recolectada y la calificación legal. En el caso de solicitar una medida coercitiva o la prisión preventiva, la Fiscalía debe indicar concretamente el riesgo procesal (por ejemplo, el peligro de fuga o entorpecimiento).

Una vez imputados los cargos, comienza la investigación penal preparatoria, que tiene un plazo máximo de 4 meses para recabar más evidencias y llegar a un sobreseimiento o una acusación.
