ARIEL ROSENDO RECUPERÓ SU LIBERTAD

El tribunal rechazó la prórroga de la prisión preventiva, y ordenó la inmediata libertad del imputado, Ariel Rosendo, que deberá seguir una serie de pautas de conducta, mientras continúe el desarrollo del juicio.

En una audiencia que se celebró de forma virtual a través del sistema Cisco Webex, el tribunal presidido por el Dr. Aníbal Astudillo, e integrado por las Dras. Sandra Ehrlich y Daniela Estrada, dio a conocer la resolución frente al pedido efectuado por el Ministerio Público Fiscal respecto a la prórroga de la prisión preventiva al imputado, Ariel Omar Rosendo, en marco de una causa donde se lo juzga como presunto autor de  los delitos de robo doblemente calificado por efracción o fractura y por ser en poblado y en banda, desobediencia a una orden judicial y violación de las medidas anti epidémicas en concurso ideal.

Luego de enumerar los argumentos sostenidos por cada una de las partes en la audiencia anterior, y haciendo referencia a lo dispuesto por el Art. 210 del Código de Procedimiento Penal de la provincia de San Luis, el Dr. Astudillo dio a conocer la resolución por la que se dispuso:

“No hacer lugar al pedido de prórroga de prisión preventiva que viene cumpliendo el señor Ariel Omar Rosendo

Disponer su inmediata libertad debiendo oficiarse al Servicio Penitenciario Provincial para su inmediata ejecución

Disponer las siguientes pautas de conducta al procesado: a) fijar domicilio en el ámbito de jurisdicción de este tribunal y responder a cada citación de la autoridad judicial, b) prohibición de ausentarse de la ciudad sin la debida autorización judicial hasta el dictado del veredicto definitivo, c) el encartado deberá presentarse cada siete días por ante la Oficina Judicial del Colegio de Jueces Penales donde deberá registrar su comparendo, d) dictar la medida cautelar de prohibición de acercamiento del Sr. Ariel Omar Rosendo de datos personales obrantes en autos hasta una distancia de 200 metros respecto de la particular damnificada, su domicilio, lugar de trabajo y esparcimiento, asimismo ordenar la prohibición de mantener cualquier tipo de contacto llámese personal, telefónico, por redes sociales o por cualquier otro medio respecto de la particular damnificada, que perdurará hasta el día del dictado del veredicto”.

El Dr. Astudillo informó que la liberación ordenada podrá ser revocada en caso de incumplimiento.

Los hechos por los que se investigó al imputado, sucedieron el 18 de mayo de 2020 durante el aislamiento social preventivo y obligatorio. El acusado habría ingresado de manera violenta al domicilio de su ex esposa rompiendo las puertas de ingreso a la morada y sustrayendo ilegítimamente una serie de bienes muebles que eran propiedad del organismo gremial SMATA.
