LA JUSTICIA CONDENÓ A TRES AÑOS DE PRISIÓN EN SUSPENSO AL EX SENADOR ARIEL ROSENDO

Este lunes por la tarde, el tribunal integrado por el Dr. Aníbal Astudillo y por las Dras. Sandra Ehrlich y Daniela Estrada dio a conocer el veredicto.

Hoy, después de las 19 horas, se dio a conocer el veredicto en la causa donde se juzgó a Ariel Omar Rosendo. Con un voto en disidencia, el tribunal resolvió declarar al imputado como responsable de los delitos de robo simple (dos hechos), desobediencia a una orden judicial y violación de las medidas anti epidémicas y lo condenó a sufrir la pena de 3 años de prisión en suspenso.

El tribunal fue presidido por el Dr. Aníbal Astudillo, e integrado por las Dras. Sandra Ehrlich y Daniela Estrada. Como fiscal de juicio intervino el Dr. Maximiliano Bazla Cassina;  en representación de las querellas, la Dra. Leticia Latini y los  Dres. Omar Uría y Guillermo Alfredo Gatica (SMATA), mientras que como defensores del imputado actuaron los Dres.  Marcos Juárez y Ramiro Rubio.

En la sala de juicios Nº 2 de los tribunales de Villa Mercedes, minutos después de las 19 horas, el Dr. Aníbal Astudillo dio a conocer lo resuelto, por mayoría:

Declarar al acusado Ariel Omar Rosendo autor penalmente responsable de los delitos de robo simple, Art. 164 del Código Penal; desobediencia de una orden de la autoridad judicial, Art. 239 del Código Penal; violación de  las medidas anti epidémicas, Art. 205 del Código Penal, todo ello en concurso ideal, Art. 54 del Código Penal y condenarlo a sufrir la pena de tres años de prisión en suspenso, accesorias legales y costas procesales.

Comunicar al Registro Nacional de Reincidencia.

Remítanse las presentes actuaciones al Juzgado de Ejecución Penal para que asuma la correspondiente ejecución de pena. Ordene el cese de las medidas celebradas en la audiencia el 31/10/2022

Disponer a Ariel Omar Rosendo la prohibición de acercamiento respecto de la señora I.M. a menos de 200 metros del lugar de residencia, esparcimiento y frecuencia de la misma hasta el agotamiento de la pena impuesta, además deberá el condenado cumplimentar las pautas de conducta estipuladas el Art. 27 bis del Código Penal bajo apercibimiento de ley.

Téngase presente las reservas formuladas por la querella de Smata.

Cabe mencionar que también se dio lectura al voto en disidencia de la Dra. Sandra Ehrlich.

Los hechos – Etapa de alegatos

Previo al alegato de las partes, el imputado declaró. “He pedido declarar con mis abogados porque la verdad me cansé de tantas mentiras”, dijo. Exhibió comprobantes de compra y aseguró: “todo lo que estaba adentro del domicilio fue comprado por mi persona”.

“Quiero aclarar que todos los muebles son míos, ninguno lo compró Smata”, agregó.

“Quiero terminar diciendo que está disponible el dinero para arreglar las dos cerraduras y la alarma que, aclaro, es de mi propiedad y pido disculpas por haber ingresado de la forma que lo hice en el domicilio de la calle Italia 426”, concluyó.

Cabe recordar que los hechos por los que se investigó al imputado, sucedieron el 18 de mayo de 2020 durante el aislamiento social preventivo y obligatorio. El acusado habría ingresado de manera violenta al domicilio de su ex esposa rompiendo las puertas de ingreso a la morada y sustrayendo ilegítimamente una serie de bienes muebles que eran propiedad del organismo gremial SMATA.

Luego de la declaración de Rosendo, el tribunal dio por iniciada la etapa de alegatos.

En primer lugar, el fiscal de Juicio, Dr. Maximiliano Bazla Cassina, calificó al imputado como co autor del delito de robo doblemente calificado – por efracción y por ser cometido en poblado y en banda -; y autor de los delitos de desobediencia a una orden judicial y violación de las medidas anti epidémicas, todo en concurso real.

Relató cada una de las circunstancias en la que se produjeron los hechos y explicó, en relación a la violación de las medidas anti epidémicas, que “quedó demostrado que cometió el delito previsto en el artículo 205 del Código Penal, no cumplió con el aislamiento que debió haber cumplido”.

A continuación, explicó que, en marco de un expediente de violencia familiar, existía una orden de restricción que el imputado no respetó. “El señor A.R. había sido debidamente notificado de una prohibición de acercamiento. Lo cierto es que él se acercó a un domicilio al que no debía acercarse sin que existiera una causa justificada”, dijo. Consideró que incurrió en el delito previsto en el Art. 239 del Código Penal Argentino.

Enumeró la cantidad de testigos que vieron al imputado apoderarse de bienes. Explicó que hubo dos damnificados por el hecho de robo – la ex pareja del acusado y Smata -. “Claramente está acreditado el apoderamiento de bienes ajenos”, dijo.  Detalló que la rotura registrada en la puerta de ingreso califica al hecho como robo por efracción.

Comentó que el hecho se cometió en poblado y en banda, que participaron más de tres personas, cada una con un rol específico, “tendiente al fin que era apoderarse de bienes”.

Explicó al tribunal que los hechos se produjeron en un marco de violencia de género. Citó la Ley Nº26.485, de Protección Integral para Prevenir, Sancionar y Erradicar la Violencia contra las Mujeres en los ámbitos en que desarrollen sus relaciones interpersonales. Destacó los artículos 4 y 5 de la mencionada norma.

“Todo lo narrado por este Ministerio Público Fiscal debe ser analizado con perspectiva de género”, solicitó al tribunal. Por último, pidió que, una vez declarada la culpabilidad del imputado, se lo condene a sufrir la pena de 6 años de prisión, accesorios legales y costas procesales.

A continuación, en representación de Smata, los Dres. Omar Uría y Guillermo Alfredo Gatica, adhirieron a la solicitud de pena y calificación legal efectuada por el fiscal de Juicio.

“En base al exhaustivo análisis realizado por el Ministerio Público Fiscal, se demuestran las mentiras en las que ha incurrido el imputado. No me cabe duda alguna que el señor Rosendo es autor materialmente responsable de los delitos que se le atribuyen”, dijo Uría.

En tanto, el Dr. Gatica repudió que el acusado estuviera acompañado por su hija en el momento de cometer el hecho delictivo y lo consideró un agravante. Se reservó el derecho de plantear recursos extraordinarios en caso de que lo resuelto por el tribunal esté en contra de los intereses de Smata.

Luego, la Dra. Leticia Latini, en representación de la particular damnificada, también adhirió a la solicitud de pena y calificación legal efectuada por el fiscal de Juicio. Pidió al tribunal que el caso sea abordado con perspectiva de género. Explicó que los delitos se cometieron en un contexto de violencia de género.  Recordó que el estado argentino asumió un compromiso muy importante al adherirse a la Convención Interamericana para Prevenir, Sancionar y Erradicar la Violencia contra la Mujer (conocida como Convención de Belém do Pará).  Mencionó la adhesión provincial a la Ley Micaela.

Por último, en representación del imputado tomaron la palabra los Dres. Marcos Juárez y Ramiro Rubio.

El Dr. Marcos Juárez explicó que, tal como lo anunció en los alegatos de apertura, “no discutiría cuestiones indiscutibles”. “No voy a discutir estas dos figuras, la violación de medidas anti epidémicas y la desobediencia a una orden judicial, lo que se va a discutir es la calificación más gravosa que pesa sobre el acusado”, dijo.

Su alegato se centró en la discusión sobre el robo doblemente calificado. Aseguró que las querellas y el Ministerio Público Fiscal hicieron una valoración parcial de las pruebas. Explicó que ninguna de las hipótesis previstas en los agravantes pueden prosperar.

En tanto que, el Dr. Rubio dijo que la pena debe ser “justa y proporcional al daño efectivamente causado, en base a probanzas rendidas a través del juicio oral”. Enumeró las penas previstas para cada uno de los delitos por los que se acusa a su defendido y explicó que pasó dos años en prisión “en los que perdió todo”. Solicitó la pena de dos años y en tanto el tiempo de prisión que sufrió, se tenga por computada la misma.
