LA CORTE SUPREMA CONFIRMÓ UNA CONDENA DE 13 AÑOS DE PRISIÓN PARA MILAGRO SALA

El máximo tribunal convalidó la pena por los delitos de “asociación ilícita, en carácter de jefa, fraude a la administración pública y extorsión, en calidad de coautora”.

La Corte Suprema dejó firme la condena a 13 años de prisión por asociación ilícita contra la dirigente social jujeña Milagro Sala, quien cumple actualmente con domiciliaria en su provincia.

Los jueces del máximo tribunal ratificaron la condena dictada por el Tribunal en lo Criminal número tres de Jujuy, que dispuso además la “inhabilitación absoluta por el mismo término” para Sala por los delitos de “asociación ilícita, en carácter de jefa, fraude a la administración pública y extorsión, en calidad de coautora”.

La condena sostiene que Sala implementó “un sistema de recaudación ilegal a costa del erario público, en el marco de programas federales y provinciales de construcción o mejoramiento de viviendas, que tuvo por finalidad el injusto provecho de la jefa e integrantes de la asociación ilícita”.

En un fallo de medio centenar de páginas, los jueces Horacio Rosatti, Carlos Rosenkrantz, Juan Carlos Maqueda y Ricardo Lorenzetti consideraron que no estaba habilitada la instancia de la Corte Suprema para la revisión del fallo.

No obstante, analizaron las conclusiones de todas las instancias anteriores y rechazaron los planteos de la defensa de la líder de la Túpac Amaru.

El fallo sostiene que la defensa de Milagro Sala “no se hizo cargo de controvertir los argumentos esgrimidos por los tribunales locales para desestimar los agravios referidos a la presunta vulneración al derecho de defensa en juicio, derivados del rechazo de parte de la prueba ofrecida, la indeterminación de la imputación en su contra y la infracción del principio de congruencia”.

La Corte le restó trascendencia al caso de Milagro Sala, en términos políticos: “tampoco se halla configurada la gravedad institucional alegada, en tanto este planteo no cuenta con un desarrollo suficiente con relación a la existencia de un interés que exceda el individual de la parte y afecte de manera directa al de la comunidad o el funcionamiento de las instituciones básicas de la Nación”.

La Corte tomó por válidas todas las pruebas utilizadas en las instancias anteriores para dictar la condena y sostuvo que los cuestionamientos planteados por la defensa de la dirigente social jujeña son “meras discrepancias” con lo resuelto.

“Esa mera discrepancia con lo resuelto elude rebatir los argumentos que convalidaron esos hechos, suficientemente determinados por los jueces de la causa por medio de las declaraciones de quienes se tuvo por probado fueron sus víctimas, la de otros testigos y por prueba documental”, justificaron los jueces del alto tribunal.

En ese sentido, asignaron especial valor probatorio contra Sala a “los cheques y facturas involucrados en estos hechos- de la que también surgían los datos fácticos relevantes”.

La Corte también le creyó a los testigos de cargo que declararon a lo largo del proceso y que fueron objetados por Sala.

“La crítica (de la defensa) importa un cuestionamiento dogmático a la credibilidad de los testigos cuyos dichos fueron tomados en cuenta, la que resulta insuficiente”, sostuvieron.

Esos cuestionamientos de la defensa de Sala se basaron “en una aseveración unilateral que por un lado no se ajusta –por falta de correspondencia- a los concretos fundamentos del fallo apelado, ni tampoco los refuta por omitir toda crítica al respecto”.

“Es un criterio sostenido por esta Corte que la autonomía que la Constitución Nacional reconoce a las provincias requiere que se reserven a sus jueces las causas que en lo sustancial del litigio versen sobre aspectos propios de esa jurisdicción, en virtud del respeto debido a sus facultades de darse sus propias instituciones y regirse por ellas”, dijeron los jueces al explicar por qué no debían adentrarse en la revisión de los decididos por la Justicia de Jujuy.

“Los pronunciamientos por los cuales los más altos tribunales provinciales deciden acerca de los recursos locales que son llevados a su conocimiento no son susceptibles de revisión por la vía del recurso extraordinario, salvo que se demuestre una lesión a un derecho de raigambre federal o que la sentencia, por sus graves defectos de fundamentación o razonamiento, no constituya una derivación razonada del derecho vigente”, lo que –según los jueces- no ocurrió en este caso.
