COPARTICIPACIÓN: EL GOBIERNO NO ACATARÁ EL FALLO DE LA CORTE PORQUE “ES DE IMPOSIBLE CUMPLIMIENTO”
El presidente Alberto Fernández analizó la decisión judicial junto a 14 gobernadores, Alberto Rodríguez Saá entre ellos.
El Gobierno nacional no acatará el fallo de la CSJ que restituyó fondos de coparticipación a la CABA, al considerar que «es de imposible cumplimiento» y «tiene una mirada unitaria» de la Argentina.
“En un fallo inédito, incongruente y de imposible cumplimiento”, señala un comunicado firmado por el presidente Alberto Fernández y 14 gobernadores con los que se reunió este mediodía en la Casa Rosada para fijar postura sobre el fallo de la Corte que obliga a la Nación a entregarle a la Ciudad el 2,95% de la masa de fondos coparticipables.
Además, el texto oficial precisa: “El presidente de la Nación ha decidido instruir a los órganos competentes del Estado Nacional a recusar a los miembros de la Corte Suprema y a presentar el pedido de revocatoria ‘in extremis’ de la resolución cautelar dictada”.
El documento conjunto se dio a conocer seis horas después haber finalizado la reunión en la Casa de Gobierno, la cual contó con contó la presencia de 10 mandatarios provinciales y cuatro de manera virtual.
En tanto, el escrito aclara que los gobernadores «instruirán a las autoridades competentes de sus jurisdicciones para que los estados provinciales soliciten ser tenidos por parte en el expediente acompañando la recusación de los ministros firmantes de dicha media cautelar y para que soliciten la revocación ‘in extremis’ de la misma».
El documento lleva la firma de los gobernadores Axel Kicillof (Buenos Aires), Gildo Insfrán (Formosa), Raúl Jalil (Catamarca), Osvaldo Jaldo (Tucumán), Gustavo Bordet (Entre Ríos), Ricardo Quintela (La Rioja), Sergio Uñac (San Juan), Gerardo Zamora (Santiago del Estero), Mariano Arcioni (Chubut), Sergio Ziliotto (La Pampa), Alberto Rodríguez Saá (San Luis), Jorge Capitanich (Chaco), Gustavo Melella (Tierra del Fuego) y Alicia Kirchner (Santa Cruz).
«La Corte Suprema de Justicia de la Nación, sin fundar el modo por el cual construye dicho monto, decide aumentar ese porcentaje al 2,95; es decir, le otorga a la Ciudad de Buenos Aires más de 180 mil millones de pesos adicionales a los que ya percibe», señala el comunicado.
Asimismo, recordaron que «en la actualidad, según la ley 27.606 vigente y aprobada por el Congreso Nacional en el año 2020, la Ciudad de Buenos Aires recibe, como lo hace desde el año 2002, el equivalente al 1,4% del total de los fondos coparticipables y, además, el monto equivalente al costo de funcionamiento de la policía de la Ciudad de Buenos Aires que se le transfirió en el año 2016».
Respecto al fallo, consideraron que la Corte sostiene, de manera «insólita», que «transferirle estos montos millonarios a la CABA no afecta a las provincias argentinas», y retrucaron: «Esto es completamente falso: esos recursos saldrían del presupuesto nacional, que se ejecuta en políticas públicas, en todo el territorio de la Nación».
«En un fallo político, de cara al año electoral, la Corte Suprema pretende sustraerles recursos a todas las provincias para dárselos al jefe de gobierno de la CABA. Esta medida es, en las condiciones actuales, de imposible cumplimiento, toda vez que el Congreso Nacional aprobó por ley el presupuesto 2023 sin contemplar crédito presupuestario para tal finalidad», concluyeron.
Por su parte, el gobernador de Tierra del Fuego, Gustavo Melella, se expresó a través de las redes sociales: «Luego de reunirnos con el Presidente de Nación, Alberto Fernández, las y los Gobernadores coincidimos en que el fallo de la Corte Suprema tiene una mirada unitaria, netamente centralista del país, que es de imposible cumplimiento para el Gobierno nacional».
En un posteo realizado en su cuenta de Twitter, Melella afirmó que el fallo del máximo tribunal de Justicia es «un golpe al federalismo para beneficiar políticamente a la Ciudad de Buenos Aires, en especial a su Jefe de Gobierno (Horacio Rodríguez Larreta) en desmedro de todas las provincias argentinas».
«Es claro que suspender la aplicación de una ley del Congreso y ordenar a la Nación a otorgar el equivalente a 2,95% de fondos coparticipables, ha sido una decisión para beneficiar a Larreta y perjudicar a las provincias y a la Nación», apuntó.
También se expresó a través de las redes sociales Sergio Ziliotto: «Defender el Federalismo es Defender La Pampa. Como siempre lo hicimos, como siempre lo haremos».
