LA FISCALÍA PIDIÓ PERPETUA PARA LOS RUGBIERS PORQUE “TODOS HICIERON TODO PARA MATAR” A BÁEZ SOSA
Los fiscales Juan Manuel Dávila y Gustavo García pidieron la pena de prisión perpetua para los ocho rugbiers por el crimen de Fernando Báez Sosa ocurrido el 18 de enero de 2020 frente al boliche Le Brique en Villa Gesell y dijeron que los acusados atacaron a la víctima “por sorpresa” y bajo “traición” y que lo mataron tras golpearlo “brutalmente”.
Además, los fiscales también solicitaron que se abra una investigación contra Juan Pedro Guarino y Thomás Colazo por el delito de “falso testimonio” ya que cuando declararon dijeron que no se acordaban lo ocurrido a pesar de haber estado a pocos metros de donde ocurrió el ataque y crimen: “No se acordaron de nada… No tengo dudas de que por una omisión, mintieron”.
Durante las casi cuatro horas de alegatos, los fiscales se explayaron en las pruebas y testimonios que se presentaron durante las 13 audiencias del juicio y dieron a conocer los motivos por los cuales los ocho acusados son coautores del asesinato, y manifestaron que “todos hicieron todo para atacar y matar a Fernando”. “Se los acusa a todos por igual por el delito de homicidio doblemente agravado por alevosía y por el concurso premeditado de dos o más personas en concurso ideal con lesiones”, indicó Dávila.
Los fiscales relataron cómo comenzó el incidente entre ambos grupos en el interior de Le Brique y calificó el hecho como homicidio doblemente agravado por haber sido cometido con alevosía con concurso premeditado de dos o más personas, una figura que contempla prisión perpetua. “Acordaron matar a Fernando”, manifestó uno de los fiscales, y explicó que “el ataque” comenzó a las 4:44:25 del 18 de enero frente al boliche Le Brique y expuso distintos videos.
Parte de los mismos fueron cuestionados por la defensa de los acusados por entender estaban editados y hasta dijeron que hubo “montaje”, algo que fue descartado por el Tribunal. Según la Fiscalía, la alevosía fue “por la menor posibilidad de defensa de la víctima” y que Fernando “se vio disminuido ante la pluralidad de agentes”.
En cuanto a la premeditación, el otro agravante, García dijo que no necesariamente implica gran planificación y que los imputados “siete minutos antes del ataque” se reunieron a metros de donde estaba Fernando, luego que ambos grupos fueron echados de Le Brique por la seguridad.
“Ahí está la organización, lo de atacar sin ningún riesgo, Fernando estaba con sus amigos comiendo un helado de uva”, argumentó la Fiscalía al exponer uno de los videos del inicio de la golpiza y que, según él, se le podría atribuir ese puñetazo inicial a Enzo Comelli, uno de los rugbiers implicados.
Fernando Báez Sosa cayó casi al instante, relató García. “Los testigos hablaron de emboscada y que los imputados no atacaron desde un sólo lugar”, agregó. “Lo mataron todos, tal como estaba previsto”, citó la Fiscalía para argumentar la premeditación y, sobre todo, la coautoría, esto es que tienen el mismo nivel de responsabilidad quienes le pegaron a Fernando como los que le pegaron a los amigos del joven para impedir que lo vayan a defender.
También como prueba se argumentó que los acusados “filmaron” el inicio del ataque y dijo que eso es prueba de la premeditación. “Hubo 23 testigos presenciales del hecho y dicen que instantáneamente le pegaron a Fernando”, agregó. “Le recomiendo a los jueces que vean los videos”, dijo el fiscal y valoró la prueba que hay de los distintos “escenarios” que se pudieron ver acerca de los hechos.
