Edgar David Nicollier Giacomuzzi fue condenado hoy a tres años de prisión en suspenso y declarado responsable en carácter de autor del delito de grooming, previsto en el Art. 131 del Código Penal Argentino.
Además, la jueza Mirta Ucelay de Garciarena, subrogando en el Juzgado de Garantía Nº 2 de la Segunda Circunscripción Judicial, le ordenó fijar domicilio en la provincia de Mendoza, de donde es oriundo, y le impuso una prohibición de acercamiento y de cualquier tipo de contacto frente a las víctimas.
En el inicio de la audiencia, las partes explicaron el acuerdo para concluir la causa mediante el procedimiento de juicio abreviado, conforme lo previsto en el Art. 234 del Código de Procedimiento Penal de la provincia de San Luis.
En representación del Ministerio Público Fiscal, la fiscal Daniela Torres, acompañada por el fiscal adjunto Gastón Yllera, recordó las circunstancias en las que se inició la investigación y explicó que el delito se encuadra en lo previsto en el art. 131 del Código Penal Argentino y que se acordó una pena de tres años de prisión en suspenso.
Torres describió las circunstancias que motivaron el inicio de la investigación. Dijo que hubo dos víctimas. La primera denuncia se radicó el pasado 7 de febrero, cuando la madre de una de las niñas informó que su hija recibía mensajes a través de la red social Instagram de alguien que le requería imágenes de índole sexual.
La defensa, representada por la abogada Alejandra Zunini y el procurador Adolfo Cafieri, no formuló objeciones. Cuando le cedieron la palabra al acusado, reconoció su autoría, la calificación legal efectuada y la imposición de la pena, todo conforme lo señalado por la representante del Ministerio Público Fiscal.
Luego de escuchar a las partes, la jueza Ucelay comunicó la admisibilidad del juicio abreviado y declaró a Edgar David Nicollier Giacomuzzi responsable del delito de grooming, en calidad de autor y lo condenó a sufrir la pena de tres años de prisión en suspenso, disponiendo su inmediata libertad, sin perjuicio de quedar a disposición de alguna autoridad que así lo requiera.
