MEDIA SANCIÓN A LA LEY DE ALCOHOL CERO AL VOLANTE EN LAS RUTAS DE SAN LUIS
La Cámara de Diputados aprobó por unanimidad la adhesión de la Provincia de San Luis a la Ley Nacional Alcohol Cero al Volante que consiste en la prohibición de poseer un nivel de alcohol en sangre superior a cero al momento de manejar cualquier tipo de vehículo por las rutas provinciales.
El proyecto deberá ser aprobado por el Senado puntano para que se convierta en ley. Hasta el momento son 16 provincias con leyes de alcohol cero al conducir.
Hay una estadística de la Agencia Nacional de Seguridad Vial que indica que uno de cuatro siniestros viales fatales se detectó alcohol en sangre en alguna de las personas conductoras.
La diputada Claudia Pinelli expuso los puntos del proyecto mencionando que se adhiere a la ley nacional y que se modifica también la ley provincial. El artículo que establece la prohibición dice: “Conducir con impedimentos físicos o psíquicos, sin la licencia especial correspondiente o habiendo tomado estupefacientes o medicamentos que disminuyan la aptitud para conducir. Asimismo, queda prohibido conducir cualquier tipo de vehículos con una alcoholemia superior a cero (0) miligramos por litro de sangre. La autoridad de aplicación realizará el respectivo control mediante el método adecuado aprobado a tal fin por el organismo competente”.
Los titulares de los diversos bloques de la Cámara (albertismo, poggismo, adolfismo, radicales, etc.) manifestaron su apoyo a la ley, lo que se terminó plasmando en la votación.
Cabe recordar que a mediados de abril, el Senado de la Nación, sancionó la Ley Nacional Alcohol Cero al Volante para conductores que circulen por rutas nacionales, y la ley comenzó a regir en mayo.
El cajoneo de alcohol cero en casi una década
Durante varios años se presentaron proyectos de leyes provinciales para el alcohol cero al manejar. Como informó La Gaceta en 2014, el entonces diputado José Giraudo presentó su iniciativa. Para fines de noviembre, el proyecto tuvo la media sanción de la Cámara de Diputados, pero el Senado nunca lo trató. Lo cajoneó y perdió estado legislativo luego de dos años.
Para 2018, la diputada Verónica Causi, pareja de Giraudo, presentó un nuevo proyecto, pero también fue cajoneado y perdió estado legislativo.
A nivel municipal, el intendente Sergio Tamayo, anunció en marzo de 2022, que remitía al Concejo Deliberante el proyecto de ordenanza de alcohol cero y todavía no fue tratado.
Alcohol cero en 17 provincias
Es importante mencionar que hay 17 provincias con leyes vigentes de alcohol cero al volante: Chubut, Córdoba, Entre Ríos, Jujuy, La Pampa, Río Negro, Salta, Santa Cruz, Tierra del Fuego, Tucumán, Chaco, La Rioja, Buenos Aires, y posterior a la promulgación de la ley nacional se adhirieron Formosa, Santiago del Estero y Neuquén.. A las provincias mencionadas hay que sumarle la prohibición en rutas nacionales.
Provincias vitivinícolas como Mendoza y San Juan no tienen leyes de alcohol cero. Incluso sus legisladores nacionales no apoyaron la ley nacional cuando se trató en el Congreso. Lo que es más, Mendoza afirma que no adhiere al alcohol cero en rutas nacionales.
