OTRO REVÉS JUDICIAL PARA RODRÍGUEZ SAÁ: LA CORTE SUPREMA DECLARÓ INCONSTITUCIONAL LA EXPROPIACIÓN DE SIERRAS DE LAS QUIJADAS

La norma estableció que el parque seguiría “manteniendo el status jurídico de área natural protegida”, pero ya no sería administrado por Parques Nacionales, sino por el pueblo huarpe de San Luis.
Esta decisión había provocado cuestionamientos de la administración de Parques Nacionales, ya que consideraban ilegítima esa normativa local por vulnerar la primacía del orden jurídico federal y la distribución de competencias establecidas por los artículos 31 y 75, inciso 30 de la Constitución Nacional.
El caso llegó a la Corte Suprema, que hizo lugar a la demanda y declaró la inconstitucionalidad de la Ley V-0721-2010 de la provincia, al entender que San Luis “no puede arrogarse sin más la propiedad de un establecimiento de utilidad nacional que no ha sido desafectado de su destino al uso público por una ley del Congreso Nacional y, por lo tanto, desconocer el régimen legal del referido parque nacional”.
De esta manera, el máximo Tribunal del país expresó que “aun cuando la facultad expropiatoria sea una de las reservadas por las provincias dentro de su territorio, tal atribución cede cuando el inmueble pertenece al Estado nacional y en él funciona un establecimiento de utilidad nacional”.

A su vez se añadieron en un apartado que el Instituto Nacional de Asuntos Indígenas (INAI) informó que no tiene constancia de que en el área protegida que comprende el “Parque Nacional Sierra de las Quijadas”, como en el resto de la Reserva Natural adyacente, residan miembros o comunidades pertenecientes al pueblo Huarpe. Lo que deja sin efecto los dichos del gobernador Alberto Rodríguez Saá.
Además, se mencionó en el fallo que “dicho instituto informó que no ha recibido solicitud alguna por parte de las comunidades Huarpes para realizar el relevamiento técnico-jurídico-catastral en el área mencionada”.
Según se describió en la sentencia el Registro Nacional de Comunidades Indígenas (Renaci) informó que la comunidad Huarpe Guanacache está inscripta pero no se encuentra asentada en el área protegida ni en la reserva natural referida, sino en el paraje La Represita del departamento Ayacucho.
Con esta sentencia, la Corte condenó al Gobierno de San Luis a “otorgar en el plazo de ciento 120 días hábiles las escrituras traslativas de dominio correspondientes” a los inmuebles expropiados.
