CONFIRMARON A LOS JUECES QUE INTERVENDRÁN EN EL JUICIO POR EL ATENTADO CONTRA CRISTINA KIRCHNER
Son Sabrina Namer y Adrián Grünberg. La defensa del jefe de «los copitos» los había recusado por «kirchneristas».
La Cámara Federal de Casación ratificó a dos de los jueces que intervendrán en el juicio oral por el atentado contra Cristina Fernández de Kirchner, quienes habían sido objetados por la defensa del jefe de “los copitos”, Gabriel Carrizo, por “kirchneristas”.
El máximo tribunal penal del país rechazó el recurso interpuesto por la defensa de Carrizo, a cargo del penalista Gastón Marano, contra los jueces Sabrina Namer y Adrián Grünberg.
La medida es una virtual confirmación de la fecha de inicio del juicio oral, prevista para el próximo 26 de junio.
Los camaristas Ángela Ledesma, Guillermo Yacobucci y Alejandro Slokar ratificaron la desestimación de la recusación, fundamentada en el “temor de parcialidad” que le generaba a Carrizo la supuesta afinidad los jueces con la ex presidenta, querellante en la causa por el atentado contra su vida.
Ambos jueces aludidos rechazaron el planteo y esa decisión fue confirmada en primera instancia por un tribunal integrado especialmente -y sin ellos, con otros magistrados- para resolver las recusaciones.
Ese tribunal, integrado por los jueces Ignacio Carlos Fornari, Daniel Horacio Obligado y Javier Feliciano Ríos, desestimó las recusaciones argumentando que “un magistrado puede, en principio, ser recusado tanto en los casos en que está excluido de pleno derecho del ejercicio de la función jurisdiccional como también en razón del temor de parcialidad, mas éste sólo se admite cuando existe un motivo idóneo que justifique la desconfianza hacia la imparcialidad del juez”.
“Ninguno de tales supuestos ha sido verificado en los planteos que motivaron este decisorio”, sentenciaron.
La medida fue apelada por el abogado Marano pero hoy el máximo tribunal penal confirmó la continuidad de Namer y Grünberg en el tribunal que juzgará a Carrizo, a Fernando Sabag Montiel y a Brenda Uliarte, los tres únicos detenidos por el intento de magnicidio.
Ambos jueces, más Carlos Fornari, integrarán el Tribunal Oral Federa número seis, que desde el próximo 26 de junio tiene previsto celebrar el debate.
