EL SENADO APROBÓ EL DNU QUE DECLARA LA EMERGENCIA ECONÓMICA, FINANCIERA, ADMINISTRATIVA, SOCIAL, ALIMENTARIA, SANITARIA, EDUCATIVA Y DE SEGURIDAD
El oficialismo logró aprobarla por mayoría, con discrepancia de votos en el bloque opositor.
Fue el marco legal que tuvo el gobernador Claudio Poggi para tomar una serie de medidas para encarrilar el Gobierno y ordenar la administración al asumir la gestión.
El Senado aprobó por mayoría el Decreto de Necesidad y Urgencia N° 150-SGG-2023 que declaró la emergencia pública en materia económica, financiera, administrativa, social, alimentaria, sanitaria, educativa y de seguridad por un año y con la posibilidad de prorrogarse por el mismo periodo por parte del Ejecutivo.
La votación fue 5 a 4. Recibió el aval de los legisladores de Cambia San Luis, Martín Olivero, Adolfo Castro Luna y Sergio Guardia; del bloque unipersonal Acuerdo por el Interior Sanluiseño, Diego García; y de Carlos García del departamento Belgrano (bloque Unión por San Luis).
Salvo Carlos García, los demás senadores albertistas del bloque Unión por San Luis, Sergio Moreira, Hugo Olguín, Juan Torres y Mariana Cruz votaron en contra.
El Decreto de Necesidad y Urgencia, dictado por Poggi en acuerdo de ministros el 14 de diciembre, fue publicado cuatro días en el Boletín Oficial. Fue el instrumento legal para encuadrar una serie de medidas adoptadas por el Gobierno en los primeros 100 días de gestión, que estaba en receso la Legislatura.
Poggi asumió la administración con un déficit fiscal de $125 mil millones que dejó el Gobierno de Alberto Rodríguez Saá.
En el DNU se dio como fundamento “la crítica situación económica y financiera de la Provincia, la crisis alimentaria provincial y los altos índices de pobreza, el crecimiento del delito y la ineficiente respuesta del poder público, la crisis y desorden en el sistema educativo y sanitario provincial”.
Olivero expuso en el recinto que el 10 de diciembre Poggi recibió el Gobierno en “un momento crítico y con índices tremendos de pobreza e indigencia” y por eso “debió tomar cartas en el asunto ante el receso de la Legislatura dictando esta herramienta para tratar de subsanar las finanzas públicas que están en rojo desde hace varios años como constan en las Cuentas de Inversión presentadas por la administración anterior”.
El legislador explicó que el artículo 99 inciso 13 de la Constitución Nacional y la Ley 26.122 de Régimen Legal de los Decretos de Necesidad y Urgencia avalaron al Ejecutivo a dictar este DNU. También los antecedentes a nivel provincial de distintas administraciones que implementaron este tipo de medidas en “momentos claves y situaciones excepcionales”.
“No tengo ninguna duda que sin este decreto el Gobierno no hubiera podido cumplir compromisos con proveedores, acreedores, ni el pago de sueldos”, manifestó Olivero.
Los legisladores de la oposición fundamentaron su rechazo en el “poco tiempo” que tuvieron para evaluar el DNU.
“Está publicado hace más de tres meses y medio en el Boletín, cualquier ciudadano de San Luis podría haberlo estudiado a fondo, por eso creo que fue una intención de no acompañar porque el fundamento fue muy frágil”, sostuvo Olivero.
El decreto paso a la Cámara de Diputados para su aprobación definitiva. Podría ser tratado en la sesión de este miércoles.
La Cámara de Senadores dio acuerdo a las designaciones de Víctor Endeiza como Fiscal de Estado y a Omar Pecorari, en el cargo de Contador General de la Provincia de San Luis.
El ordenamiento constitucional establece que nombrados por el gobernador con acuerdo del Senado. Ambos asumieron durante el receso de la Legislatura por lo que ahora tuvieron el aval de la Cámara Alta.
Por otro lado ingresó una nota de Carlos García donde comunicaba su renuncia a la presidencia del bloque Unión por San Luis.
