El gobierno emitió el Decreto 302/2024 para liberalizar el mercado de las Tecnologías de la Información y las Comunicaciones (TIC) y de esta manera elimina la regulación de precios en los servicios de telefonía, tv por cable e internet.
Este decreto, que modifica la Ley Argentina Digital N° 27.078, representa un paso hacia la desregulación de precios en el sector, con el objetivo de fomentar la competencia, incentivar la inversión y mejorar la calidad del servicio para los usuarios de todo el país.
Bajo este nuevo marco, los licenciatarios de servicios TIC tendrán la libertad de fijar sus tarifas, una medida que busca estimular la competencia en el sector y, como resultado, promover mejoras en la calidad y diversidad de los servicios ofrecidos a los consumidores.
La publicación en el boletín oficial señala que “El presidente en acuerdo general de ministros decreta: artículo.- Sustitúyese el artículo 48 de la Ley Argentina Digital N° 27.078 y sus modificatorias por el siguiente ´los licenciatarios de Servicios de TIC fijarán sus precios, los que deberán ser justos y razonables, cubrir los costos de la explotación y tender a la prestación eficiente y a un margen razonable de operación´”.
A pesar de la desregulación de precios, el decreto reafirma la clasificación de los servicios de TIC como esenciales y estratégicos, subrayando el compromiso del Estado en garantizar el acceso universal a dichos servicios.
La normativa establece que los precios fijados por los licenciatarios deben ser justos y razonables, garantizando que cubran los costos de explotación y permitan a todos los argentinos acceder a servicios de calidad.
Una de las motivaciones detrás de esta reforma es incentivar la inversión en infraestructura de telecomunicaciones, particularmente en zonas rurales y remotas, para reducir la brecha digital en Argentina. Al liberar a los licenciatarios de las restricciones de precios, el gobierno espera estimular la expansión de redes y servicios, asegurando una cobertura más amplia y una mayor inclusión digital.
El gobierno fundamenta su decisión con los siguientes argumentos: “Que es de destacar que ante el creciente desarrollo de los servicios de telecomunicaciones, la contemplación de las diferentes circunstancias del mercado resulta fundamental, tanto para favorecer su dinamismo y generar un equilibrio competitivo sostenible como para asegurar una mayor oferta de servicios a los usuarios a precios justos y con mayor calidad, extremos que se contraponen con la regulación tarifaria establecida por el Decreto N° 690/20”.
Además, el decreto sostiene “que en cuanto al fondo de la cuestión, es importante mencionar que los servicios de TIC han sido creados en competencia, así como la prestación de los servicios de comunicaciones móviles, siendo una facultad esencial para su desarrollo y crecimiento la posibilidad de que los licenciatarios puedan fijar los precios de sus servicios libremente”.
Con esta medida, el gobierno promete transformar el paisaje de las telecomunicaciones en Argentina, pero su éxito dependerá de un equilibrio cuidadoso entre la libertad de mercado y la protección de los derechos de los consumidores.
