LA LEGISLATURA TRATARÁ LA LEY DE EXTINCIÓN DE DOMINIO
Es una herramienta jurídica que permitirá recuperar bienes que se llevó la corrupción. La norma, que recibió aportes de colegios profesionales, legisladores y especialistas en Derecho, será retroactiva y marca la imprescriptibilidad de este tipo de hechos. También asegura el derecho de defensa de los acusados.
Desde su asunción el 10 de diciembre pasado, el gobernador Claudio Poggi viene modelando, junto con la secretaría de Ética Pública y Control de Gestión y el diputado Carlos Pereyra, un proyecto de ley de Extinción de Dominio. La iniciativa tiene asidero en la ley N°26.097, por la cual la Argentina aprobó la Convención de las Naciones Unidas contra la Corrupción. Es un instrumento en el que los estados que forman parte de la ONU manifiestan su preocupación por los problemas y amenazas que plantea la corrupción para la estabilidad y seguridad de las sociedades, socavando los valores de la democracia.
También la Convención Interamericana contra la Corrupción, aprobada por la Ley N°24.759, establece que de acuerdo con las legislaciones nacionales aplicables y los tratados entre países, se prestarán mutuamente la más amplia asistencia posible en la identificación, el rastreo, la inmovilización, la confiscación y el decomiso de bienes obtenidos o derivados de la comisión de los delitos tipificados en esa Convención.
En síntesis, “la extinción de dominio constituye un instituto jurídico, autónomo e independiente de cualquier otro proceso, dirigido a eliminar el poder y capacidad de la delincuencia”, según la definió el preámbulo de la Ley Modelo sobre Extinción de Dominio redactada por la Oficina de las Naciones Unidas contra la Droga y el Delito. Es una acción civil de carácter patrimonial -que se inscribe dentro este régimen de restricción al derecho de dominio o propiedad- cuando existe una sospecha fundada respecto de la titularidad de algunos bienes cuando éstos no se corresponden razonablemente con los ingresos de su tenedor, poseedor o titular, o representan un incremento patrimonial injustificado que tiene causa en la comisión de un delito grave.
En la Argentina, hay dos antecedentes. Uno es en el orden federal, el DNU 62/19 del Poder Ejecutivo, denominado “Régimen procesal de la acción civil de extinción de dominio”, que dota al Ministerio Público Fiscal de herramientas concretas para llevar adelante juicios contra acusados por la comisión de los delitos graves y someterlos a una investigación para determinar si su patrimonio o parte de él está constituido por causa ilícita.
El otro, es una ley que sancionó Mendoza en 2019 y es la principal jurisprudencia en la materia, ya que tuvo aplicación práctica: el 21 de diciembre de 2023 subastaron un inmueble en la localidad de Guaymallén en un proceso civil de extinción de dominio. Era propiedad del exintendente Luis Lobos, quien había sido declarado culpable del delito de enriquecimiento ilícito, defraudación y administración fraudulenta.
Por supuesto que el proyecto de ley prevé que la “extinción de dominio” asegure el derecho de defensa y al debido proceso de los investigados, algo preservados por la Constitución Nacional y el ordenamiento jurídico nacional y provincial.
