María del Valle Durán, fiscal de Instrucción N° 4 de la Primera Circunscripción al frente de la causa que investiga el accionar de un hombre que ayer a la siesta realizó disparos en una escuela e hirió a su ex pareja, informó que la audiencia de formulación de cargos se realizará este jueves ante el juez de Garantías N° 3 Marcos Flores Leyes.

Respecto a la calificación de la causa, Durán explicó que está a la espera del sumario policial, pero todo indica que será caratulada como Homicidio doblemente calificado en grado de tentativa en concurso real con el incumplimiento de una orden judicial.

“En principio esa sería la caratula de acuerdo a cómo me fueron relatados los hechos y las entrevistas que he podido tomado hasta ahora”, dijo la fiscal. La policía comunicó que la víctima, que se desempeña como docente en la institución donde sucedió el ataque, había radicado días atrás una denuncia en contra de su expareja por violencia de género.

El hecho ocurrió este martes a las 15:20 horas en la Escuela Técnica N° 37 “Ingeniero Germán Avé Lallemant”, de Juana Koslay. El presunto agresor está detenido. La víctima sufrió “una herida con arma de fuego en su pierna derecha con orificio de ingreso y egreso, sin compromiso óseo, ni vascular”, de acuerdo a lo que informó el parte médico del Hospital Central “Ramón Carrillo”. Fue dada de alta anoche.

QUÉ ES UNA AUDIENCIA DE FORMULACIÓN DE CARGOS

Se trata de una de las audiencias de las primeras etapas del proceso penal establecida en el Artículo 110 del Código Procesal Penal de San Luis. Esta instancia se realiza con el propósito de que se le informe a un/a imputado/a los hechos delictivos que se le atribuyen.

Se hace de manera oral, con la presencia de todas las partes (fiscales y defensores) y a partir de la detención de una persona se buscan elementos para apoyar una imputación. Para ello se describe el hecho, la evidencia recolectada y la calificación legal. En el caso de solicitar una medida coercitiva o la prisión preventiva, la Fiscalía debe indicar concretamente el riesgo procesal (por ejemplo, el peligro de fuga o entorpecimiento).
