PRISIÓN PREVENTIVA PARA IMPUTADO DE BALEAR A UN MENOR DE EDAD PARA ROBARLE EL CELULAR
Este lunes, el Juez de Garantías Nº4 de la Primera Circunscripción Judicial, Marcelo Bustamante Marone, dictó la prisión preventiva por el plazo de 60 días a Nicolás Eduardo Baigorria “alias el Foca”, acusado de robo calificado por el uso de arma de fuego y herir de bala a un menor de edad.
El hecho que se investiga ocurrió el viernes 4 de noviembre, alrededor de las 22:30 horas, en el Barrio Estrella del Sur, cuando el damnificado salió a comprar junto a un amigo (ambos menores de edad) y fueron interceptados por 3 sujetos. Uno de ellos intentó sustraerle el celular a la víctima y al no lograr el cometido, le disparó en el rostro con un arma de fabricación casera.
A Baigorria se le formuló cargos por el delito de robo calificado por el uso de arma de fuego en poblado y en banda (Art. 166 inc. II, segundo párrafo y Arts. 167 inc. II, 42 y 45 del Código Penal).
Durante la audiencia, la Fiscalía solicitó la prisión preventiva por el plazo de 90 días y la Defensa Oficial en lo Penal se opuso a tal medida de coerción.
En la Sala de Oralidad Nº 1, intervinieron el Fiscal de Instrucción Nº 1, Emmanuel Sastre, la Fiscal Adjunta María José Scivetti y la representante de la familia querellante (menor damnificado), Adriana Algarbe.
Por parte de la Defensa actuó la Defensora Oficial en lo Penal Nº 2, Nadia Agúndez y la Defensora Adjunta Victoria Celeste Suárez.
Cabe señalar que continúan las investigaciones en la causa, ya que habría más personas involucradas en el hecho.
