COMENZÓ EL JUICIO POR LA MUERTE DE LUCIO DUPUY
Un tribunal del juicio de La Pampa, integrado por los jueces Aníbal Olié, Alejandra Ongaro y Daniel Sáez Zamora, dio inicio este jueves por la mañana al juicio oral para esclarecer el brutal crimen de Lucio Dupuy, ocurrido el 26 de noviembre de 2021 en Santa Rosa.
Las acusadas por el homicidio del menor son su madre Magdalena Espósito Valenti, y su pareja, Abigail Páez, presentes en la audiencia con sus defensores oficiales.
Lucio había ingresado al Hospital Evita de la capital pampeana con convulsiones. Los estudios posteriores revelaron lesiones internas, incluso signos de abuso sexual. Lucio, creen los fiscales del caso, fue sometido a palizas y denigraciones de todo tipo.
La imputación de Magdalena es la de homicidio triplemente calificado por el vínculo (por ser ascendiente) y con ensañamiento y alevosía; en concurso real con abuso sexual gravemente ultrajante por su duración y formas concretas de realización, triplemente agravado por ser la guardadora al momento de los hechos, por ser cometido por dos personas y por existir convivencia con la víctima menor de 18 años, como delito continuado. Su pareja está acusada del mismo delito, pero sin el agravante del vínculo familiar.
El proceso se realizará a puertas cerradas en los tribunales de Santa Rosa, ya que se trata del crimen de un menor, en medio de un fuerte operativo de seguridad con un dispositivo de vallas.
Las acusadas fueron trasladadas desde el Complejo Penitenciario N°1 de San Luis, donde se encuentran detenidas desde fines del año pasado, por temor a linchamientos y represalias.
Ambas ingresaron a la sala de audiencia por una puerta lateral de los tribunales. La fecha de alegatos está programada para el próximo 22 de diciembre y se prevé que la lectura del fallo sea en febrero de 2023.
Ramón, abuelo de Lucio, fue uno de los primeros en llegar. Un grupo de mujeres se presentó con una serie de pancartas para reclamar justicia.
Se esperan las declaraciones de más de 100 testigos: el primero será Christian Dupuy. Christian, padre de Lucio, es querellante en el proceso, con un abogado designado. La querella, además, pidió sumar el agravante de “odio al género masculino”.
“Creemos que las pruebas que hemos reunido son suficientes para acreditar estos delitos”, coincidieron los fiscales Máximo Paulucci, Verónica Ferrero y Marcos Sacco, quienes además adelantaron que pedirán la pena de prisión perpetua.
Lucio llegó al hospital Evita prácticamente sin signos vitales y a los pocos minutos constataron que estaba muerto. La primera reacción de las mujeres fue decir que habían sido víctimas de un robo. Nadie les creyó. Una hora y media después la policía pampeana allanó el domicilio donde vivían y, luego de ese operativo, la pareja quedó detenida.
Las pruebas en el expediente son graves, particularmente la autopsia. La multiplicidad de heridas y el ensañamiento que había padecido y que se apreciaba a simple vista. El cuerpo del chiquito presentaba un golpe fuerte producto, probablemente, de una patada, además de heridas compatibles con quemaduras de cigarrillos y múltiples mordeduras. Algunas lesiones eran antiguas, otras muy recientes. Más tarde, se descubrió que Lucio había sido llevado al Evita en varias ocasiones por diversas lesiones, con excusas de su madre como que el chico se había caído de una bicicleta.
Finalmente, el informe preliminar de autopsia concluyó que la causa de la muerte fue una hemorragia interna derivada de varias lesiones.
“No se puede determinar un traumatismo, un golpe, puntual que le haya causado la muerte. Sino que fue una multiplicidad de lesiones las que produjeron la hemorragia, y posterior muerte”, explicaron desde la Justicia.
