FEMICIDIO DE LAURA GODOY: SE FIJÓ EL PLAZO DE 120 PARA EL JUICIO ORAL
El Tribunal de Impugnaciones de la Segunda y Tercera Circunscripción Judicial con asiento en Villa Mercedes fijo un plazo de 120 para que se realice el juicio por el femicidio de Laura Godoy ocurrido el 26 de julio de 2021 en la localidad de Tilisarao. Además, confirmó la prisión preventiva del Cristian Alaníz, ex pareja de la víctima.
En la audiencia realizada este martes, el defensor del imputado, Bautista Rivadera manifestó que la medida carecía de razonabilidad en cuanto al plazo, puesto que si bien la investigación estaba finalizada y la Fiscalía había efectuado la acusación pertinente; aún no se llevó a cabo la audiencia de control de acusación y, por ende, no hay fecha definida para la realización del debate oral.
Por lo expuesto, solicitó que se establezca para su defendido un plazo concreto y razonable de prisión preventiva, teniendo presente que la Fiscalía ya finalizó con la etapa investigativa.
Seguidamente, la fiscal Provisoria de Instrucción N°2 de la Tercera Circunscripción, Débora Roy Gitto, explicó que la coerción procesal tenía como objeto asegurar la presencia del acusado para posibilitar la realización del juicio y/o ejecución de la pena en su momento. Es decir, evitar su fuga y/o impedir que el imputado, abusando de su libertad, pueda llegar a obstaculizar el esclarecimiento del hecho.
En ese sentido, afirmó que solicitó mantener la prisión preventiva del imputado para proteger la integridad física de la hija de la víctima y demás familiares, y garantizar la tranquilidad de los testigos y de la familia de Godoy, quienes manifestaron a la fiscalía el temor de que el imputado intente amedrentarlos.
En cuanto a la detención cautelar, aseguró que está dentro de los plazos judiciales admitidos y, por lo tanto, no hay afectación a la garantía del plazo razonable, toda vez que el imputado está en prisión preventiva desde agosto de 2021, cumpliéndose el plazo máximo de dos años que prevé la ley, en agosto de 2023.
“Por tratarse de un caso de violencia de género, que impone cumplir con la Convención de Belém Do Pará, y a los fines de asegurar la sentencia condenatoria, es necesario abordar el caso con perspectiva de género”, sostuvo la fiscal.
Al respecto, remarcó que, además de la gravedad de los hechos de la acusación, y la pena de prisión perpetua solicitada; la fiscalía “considera que la resolución del juez de garantía es correcta y que no debe hacerse lugar al recurso de la defensa, siendo la prisión preventiva la única medida para poder neutralizar estos riesgos”.
Es así que solicitó al tribunal fijar un plazo de 120 días de prisión preventiva o, en su defecto, mantener la medida de coerción hasta el inicio del juicio oral.
Finalmente, Roy informó al tribunal que, el pasado 7 de diciembre, presentó el pedido de elevación de la causa a juicio y el correspondiente ofrecimiento de prueba, contando con la conformidad del abogado que representa a los padres de Laura Godoy, Mario Mini.
Tras un cuarto intermedio, el tribunal presidido por Hernán Herrera e integrado por Sandra Gabriela Ehrlich y Daniela Estrada, resolvió:
Confirmar la prisión preventiva para el imputado, fijando un plazo de 120 días para la realización del juicio oral. Ello, considerando que el tiempo requerido por la fiscalía es razonable, y que se trata de una medida necesaria para proteger la integridad de la familia de la víctima y evitar el entorpecimiento procesal.
