Impuesto a la riqueza: reglamentación y debates en torno a su aplicación
La ola de amparos para evitar su aplicación es lo que más preocupa al gobierno
La tan discutida y resistida ley de impuesto a la riqueza fue por fin reglamentada, aunque esto no supuso que los conflictos se acabasen. Por el contrario, los especialistas creen que los huecos que deja la ley abren el espacio a que pueda terminar de resolver su aplicación en los tribunales.
Este impuesto, que alcanza a unos 12.000 contribuyentes y planea recaudar $300.000 millones para las arcas estatales, se encuentra hoy, ya promulgado, con la posibilidad cierta de una avalancha de amparos para no pagarlo. La reglamentación se dio a conocer hoy a través del Boletín Oficial, y los expertos creen que dejó abiertas varias ventanas para que, quienes estén alcanzados puedan evitar su aplicación.
Al parecer, los vicios que presenta, permitirían a los tributarios aducir que el impuesto es confiscatorio, retroactivo, o que supondría una doble imposición, cuestiones que si prosperan harían, en la práctica, nulo a este impuesto. La pregunta que se cae de madura es para que se llevó a un enfrentamiento al gobierno con los empresarios si después en la práctica, quienes están alcanzados van a terminar no pagándolo. Esas son las cosas que no se entienden del gobierno, da peleas cuyas victorias terminan siendo literalmente Pírricas. Algo parecido le paso con Vicentín, en donde impulsó un conflicto con el campo, que era innecesario, sólo para volverse atrás.
Si bien restan aún algunas cuestiones técnicas para la aplicación, sobre todo la forma en que la AFIP determine cómo y cuándo se va a pagar, así como la moneda de referencia, lo cierto es que el “Aporte Solidario y Extraordinario para Ayudar a Morigerar los Efectos de la Pandemia”, como se conoce a esta ley, tiene todos los visos de quedar en papeles. La cuestión crucial que ven los analistas en temas tributarios es que la implementación del decreto reglamentario entra en conflicto con normas legales vigentes, y eso puede ser un incentivo a judicializar todo el proceso, con lo cual es probable que la AFIP no logre recaudar un centavo más de lo que esperaba.
Una novedad que surge de la reglamentación, es que quienes estén alcanzados podrán reducir las alícuotas si repatrian dólares al tipo de cambio oficial – una opción que no es atractiva para nadie -, o si invierten el capital en sus empresas, pero esto tiene el problema de que no se van a poder pagar dividendos, lo cual generaría conflictos con los accionistas. Aunque el mayor problema de esta opción es la implementación, ya que aún no se ve como se podría hacer efectiva sin que esto genere más trastornos. Por ahora, salvo la reglamentación, hay más incógnitas y dudas que certezas. Con el correr de los días es probable que el panorama se vaya aclarando y pueda dilucidarse si efectivamente podrá implementarse el impuesto o si va a caer en el saco roto de la judicialización.
