Chile: más de 100 mujeres embarazadas por tomar anticonceptivos defectuosos

Las víctimas acusan al Estado por negligencia farmacológica, ya que el Sistema de Salud Pública brindaba el tratamiento.

En el país andino, 111 mujeres tuvieron embarazos no deseados según el Movimiento por la Interrupción Legal del Embarazo -Miles-. El motivo fue la distribución en centros públicos de salud de ocho lotes de píldoras anticonceptivas defectuosas. El Instituto de Salud Pública -ISP- había alertado el peligro y retirado las seis marcas con presuntas fallas. Sin embargo, volvió a distribuir una de ellas, Anulette CD, alegando que los lotes defectuosos eran «visiblemente descartables» y se habían encargado de ello.

Meses más tarde, muchas de las mujeres afectadas salieron a denunciar este caso de negligencia. Desde el ISP aún están evaluando su responsabilidad. La polémica se acrecenta teniendo en cuenta que la legislación vigente no permite la interrupción voluntaria del embarazo. Solamente pueden acceder al tratamiento quienes hayan sido violadas, o casos donde el feto es inviable y la vida de la mujer corre peligro.

Las víctimas deberán continuar sus embarazos no deseados, porque la negligencia farmacológica no es considerado motivo habilitante para abortar. Para Laura Dragnic, abogada del Miles, la responsabilidad es dual: del laboratorio que fabricó los medicamentos y del Estado, que no atendió las necesidades de estas mujeres ni controló la calidad de las píldoras.  La jurista afirmó: «Esto constituye una falta de servicio. No hubo ningún acompañamiento real, fue algo que el Estado trató de mantener por debajo».

En consonancia, desde Miles y la Women´s Link Worldwide elevaron un pedido de urgencia a la Comisión Interamericana de Derechos Humanos. El objetivo es que Chile tome medidas para mejorar sus servicios de salud sexual y reproductiva, en un contexto donde los derechos sexuales de la mujer chilena son cercenados.
