Enojo presidencial e internas palaciegas: el fallo contra Milagro Sala y los embates del kirchnerismo contra la justicia

Hace rato que Cristina quiere una justicia a medida. Los intentos por reformar la justicia ya son bien conocidos, y está semana el propio Fernández salió al ruedo declarando que tenia “cierta impotencia porque es un poder autónomo en la República”, olvidando que eso es justamente la división de poderes en un país que se define como democrático y republicano.

Las declaraciones del presidente no hacen más que poner en palabras lo que piensan acerca del sistema judicial en el Instituto Patria: los jueces deberían ser un apéndice del ejecutivo. Y la agenda hoy está atravesada por las necesidades de Cristina y de los “compañeros” detenidos por corrupción, pero que el kirchnerismo define con un eufemismo como “presos políticos”.

Una de las supuestas víctimas del lawfare, la teoría desarrollada por el progresismo para encubrir la corrupción, es Milagro Sala, a quién la Corte Suprema le confirmó esta semana la condena por amenazar policías en Jujuy. El presidente, se tomo este fallo como un ataque abierto a su autoridad, lo cual es un absurdo, y termina generando una ensalada rusa de caprichos, búsqueda de impunidad y socavamiento de las instituciones.

A un presidente puede no gustarle un fallo, sobre todo si afecta a un amigo o amiga, pero de allí a tomarlo a nivel personal hay una distancia muy grande, y más parece una pose para seguir reforzando la idea de la intromisión política en un poder del estado que un acto de desafío contra el presidente. El primer mandatario se comporta en ocasiones como un niño al que le arrebataron el juguete, pero el problema es que ese juguete son nuestras instituciones, y los constantes ataques contra la justicia dan muestra de hasta donde están dispuestos a llegar, y no tienen ningún escrúpulo en decirlo públicamente.

El ataque de Fernández es tan brutal, que llegó a considerar que “la Corte está mal y está descalificada por la sociedad”, y luego salieron a repetirlo desde actores hasta funcionarios. Es cierto, la justicia hace años es criticada por la sociedad, y es bueno que tome nota el presidente. Pero no menos cierto es que también la política esta descalificada y devaluada por la sociedad, pero de eso no parece darse cuenta, o sencillamente no quiere.

Venimos de un año en donde la mayoría de los argentinos hizo grandes esfuerzos para sobrevivir. Muchos perdieron sus trabajos, o tuvieron que achicarse por la creciente inflación, tuvieron que cerrar sus comercios por la cuarentena, pero la política no hizo ningún gesto, ni siquiera simbólico. Fernández tiene razón, las instituciones están devaluadas, y los únicos responsables son los políticos, sobre todo, de aquellos que tienen la responsabilidad de gobernar.

Que Milagro Sala sea culpable o no, es algo que debe determinar única y exclusivamente la justicia, algo que no acepta el kirchnerismo. De hecho, están mostrando su verdadera cara, y son los mejores representantes del lawfare que inventaron como excusa ideológica para zafar de la justicia. La utilización que hacen de los jueces amigos es repugnante, y las operaciones políticas van quedando solas al descubierto.

Esta semana tuvimos varias operaciones contra dirigentes y políticos opositores. La operación contra el marido de Carolina Píparo, a quien mantienen en prisión por lesiones leves en un accidente de tránsito, la denuncia contra Fernando Iglesias por u$s 40.000 que el diputado habría ganado por sus libros, y la orden de hacer suspender las clases en CABA a través del juez Gallardo, solo para pegarle a Larreta.

Este último es quizás el peor de todos, y muestra a las claras cual es la intención del kirchnerismo: una justicia amiga para disciplinar a los que se oponen al proyecto de poder nac&pop. El lawfare es el escenario para avanzar sobre la justicia y los objetivos son varios: librar a los “cumpas” de las causas de corrupción y crear una justicia adicta que les permita perpetuarse en el poder.

Las instituciones están en crisis, y la democracia está en riesgo, y no por Milagro Sala, sino por una dirigencia política que ha perdido el rumbo. Lentamente nuestro sistema democrático se está transformando en una pantomima, y lo que asoma en el futuro cercano es una vil dictadura disfrazada de legalidad.
