Por este accionar, el Tribunal Penal de la Tercera Circunscripción lo condenó a 13 años de prisión.

El acusado tiene más de 40 años y fue denunciado a fines de 2018. Para ese entonces la hijastra ya era mayor de edad, aunque sostuvo que los abusos se perpetraron desde que era niña. El último episodio fue cuando la mujer era una adolescente.

Tras el sumario, la Jueza Patricia Besso ordenó la detención del hombre para una audiencia indagatoria. La defensa solicitó una prorroga: una vez terminada el abusador fue procesado con prisión preventiva.

El juicio

Ayer martes dieron inicio al juicio oral, donde este hombre debió verselas con el Tribunal Penal conformado por las Dras. Sandra Piguillem y María Claudia Uccello y el Dr. Sergio Darío De Battista.

El acusado declaró que era inocente y dijo estar sorprendido por las acusaciones que pesaban en su contra. Luego declararon 8 testigos, entre ellos, su hijastra.

El Fiscal de Cámara acusó al abusador de aprovechar la situación de convivencia de ese momento para cometer los delitos de manera reiterada. Asimismo, consideraron que el testimonio de la mujer era creíble, pese a que la denuncia se hizo tiempo después de los abusos.

Al momento de solicitar la condena, la defensa manifestó que la investigación de la causa se basó en declaraciones de testigos y no en «pruebas contundentes». También sostuvo que al acusado no le practicaron ninguna pericia psiquiátrica o psicológica, por lo que solicitaron absolverlo por el beneficio de la duda.

El fallo

Tras los alegatos, el Tribunal Penal consideró al acusado culpable del delito «abuso sexual gravemente ultrajante, agravado por ser la víctima menor de 18 años y por la situación de convivencia preexistente«.

Por esos crímenes, le pesó una condena de 13 años en prisión.
