La reforma judicial obtuvo media sanción del Senado
Las reformas fueron propuestas por el ejecutivo provincial y persiguen un cambio de paradigma legal. Habrá un código procesal especial para familia, niñez y adolescencia.
Las actualizaciones en el Poder Judicial provincial son materia necesaria hace tiempo, y los proyectos de reforma avanzan para garantizar la celeridad y un mejor acceso a la justicia. El Senado de San Luis ya dio media sanción a los proyectos de reforma del Código Procesal Penal, el Código Procesal de Familia, Niñez y Adolescencia; la Ley Orgánica del Ministerio Público y la Ley de Administración de Justicia del Poder Judicial.
La propuesta vino del ejecutivo provincial y fue tratada este martes en la legislatura puntana: todos los proyectos fueron aprobados por unanimidad. Desde el gobierno sostienen que las reformas intentarán modificar el paradigma legal vigente en San Luis. Habrá cambios en la competencia de los Juzgados de Instrucción en lo Penal, Instrucción en lo Correccional e Instrucción en lo Contravencional: con las reformas los organismos de las tres circunscripciones serán renombrados como Juzgados de Garantías.
El paso al sistema acusatorio
Es uno de los grandes cambios que tendrá la justicia provincial, y aseguran que permite mayores garantías de imparcialidad. En nuestra provincia se utiliza un sistema inquisitivo, donde la acción y la investigación recae sobre el juez. En cambio, el sistema acusatorio otorga al juez el control de las garantías, mientras que deja la investigación en manos de los fiscales.
Nuevo Código Procesal Penal
Otra modificación es la conformación de un Código Procesal Penal de Niñez, Adolescencia y Familia. En estos casos, los jueces provinciales aún utilizan el Código Procesal Civil. El nuevo código buscará establecer una normativa que garantice los derechos y deberes establecidos en las leyes de fondo, regulando los procesos de familia y de violencia familiar.
El flamante código tendrá los siguientes principios generales: Especialidad en familia y violencia familiar; Interés superior del niño. Asimismo, introducirá las «cargas probatorias dinámicas» en la carga de la prueba, que recae en quien está en mejores condiciones de probar.
Además, la reforma incorpora clausulas donde se detalla que los parientes y allegados de las partes pueden participar como testigos, aunque aclara quienes están legitimados a hacer las denuncias e iniciar el proceso judicial. También se obliga a profesionales de salud, educación o funcionarios públicos, que conozcan situaciones de violencias hacia niñas, niños, adolescentes, adultos mayores y personas con capacidad restringida, a efectuar la denuncia correspondiente.
