El hombre que atropelló y mató a una niña de dos años quedó en libertad
Lo procesaron por «Homicidio culposo agravado por manejar en estado de ebriedad y darse a la fuga». No hubo prisión preventiva ni domiciliaria.
La noche del 29 de agosto la familia Rosales padeció la muerte de su pequeña hija, Xiomara, a manos de Carlos Alberto Chávez. El hombre de 70 años circulaba con 3,50 de alcoholemia a bordo de su Fiat Palio, cuando atropelló y mató a la niña de 2 años en el Barrio El Criollo de Villa Mercedes. Las pericias hechas por Silvia Sawczuk comprobaron que el conductor no paró tras chocar la cabeza y los hombros de Xiomara: la niña fue embestida por el frontal del auto y luego quedó debajo del vehículo, quedando herida de muerte.
Desde que Chávez ingresó a Tribunales no cabían dudas de que su procesamiento se daría tarde o temprano. Las miradas estaban puestas en el carácter de la pena a imponer: se habló de un crimen con dolo eventual, que reviste cierto grado de intencionalidad y una condena superior. Sin embargo, para dolor de los Rosales, Chávez salió caminando y en libertad.
La jueza encargada del caso fue Mirta Ucelay: no dictó prisión preventiva, ni domiciliaria. Para Ucelay no hubo dolo, aunque el hombre sabía que estaba alcoholizado y era consciente del riesgo que conlleva manejar así: calificó a la muerte de Xiomara como un crimen sin intención.
A Chávez lo procesaron por «Homicidio culposo agravado por manejar en estado de ebriedad y darse a la fuga». ¿La condena? Vivir en un radio cercano al Juzgado y realizarse estudios médicos para comprobar si tiene adicción al alcohol. De ser así, el homicida deberá iniciar un tratamiento. Además, le revocaron la licencia de conducir mientras la causa esté abierta.
