Perspectiva de género: proponen incorporarla en los procesos de Familia del Código Comercial y Civil

La iniciativa vino de la senadora nacional Cristina López Valverde, del Frente de Todos. Con su implementación intentan remover los patrones socioculturales que promueven y sostienen la desigualdad de género y las relaciones de poder dominantes.

La transversalidad de relaciones de poder dominantes, esencialmente patriarcales, y la desigualdad de género puede pasar invisibilizada para muchos, aunque su verdadero impacto reside en los patrones socioculturales que sustenta. A la hora de enfrentar procesos judiciales, estas categorías de percepción, de sentir y vivir el mundo, operan a modo de sesgo y dificultan el efectivo trabajo de la justicia.

Es por eso que la senadora nacional Cristina López Valverde, del Frente de Todos, propuso incorporar la perspectiva de género como un «principio general», a aplicarse en el Título VIII contenido en el Libro segundo que regulan las relaciones de familia. El proyecto de la sanjuanina sostiene: “Es fundamental que este principio sea observado en todas las etapas de estos procesos: divorcio, régimen patrimonial del matrimonio, uniones convivenciales, alimentos, derecho de comunicación, compensación económica, adopción, responsabilidad parental”.

En este sentido, López Valverde señaló:  “Usualmente en el trámite de estos procesos se exponen las desigualdades de acuerdo con algunas estructuras familiares de tipo patriarcal que quedan al descubierto en los momentos de quiebre de las familias y muchas veces las mujeres sufren una doble discriminación o expulsión, tanto en el seno intrafamiliar como en el ámbito jurisdiccional al momento de hacer valer sus derechos”.

La senadora confía en que la incorporación de la perspectiva de género ayudará a derribar estereotipos instalados, mandatos que intervienen cuando se involucra a grupos minoritarios y oprimidos. «Implica desintegrar esos mandatos patriarcales en los que fuimos educados y educadas en los aspectos de nuestra vida, laboral, institucional, familiar, desde lo simbólico hasta lo real”, cerró.
