Merlo: condenaron a 18 años de prisión a un hombre que abusó de su hijastra

Se lo acusa del delito «Abuso sexual con acceso carnal agravado». El tribunal encabezado por el juez Osvaldo Pinto lo declaró culpable pese a que el defensor había pedido la absolución de su cliente.

Ayer miércoles se resolvió que un vecino de Merlo pase 18 años en prisión, luego de haber perpetrado abusos sexuales contra su hijastra. La causa se remite a 2018, año en que la madre de la víctima denunció a su pareja luego de que la joven le confesara los abusos que sufría de este hombre desde pequeña. La pareja vivía junto a la víctima y un hijo que tuvieron en común, hermano de la joven abusada.

Luego de recabar las primeras pruebas, el juez Osvaldo Pinto solicitó el sumario judicial y detuvo al abusador. Cuando lo citaron para la audiencia indagatoria, el imputado se abstuvo a declarar. Sin embargo, la causa siguió recolectando información, tras conseguir la pericia pediátrica y los testimonios de la víctima en Cámara Gesell.

Esas primeras pruebas le valieron la prisión preventiva al abusador, que fue acusado por «abuso sexual con acceso carnal, agravado por causar grave daño en la salud mental de la víctima, por ser el encargado de la guarda y por ser cometido contra una persona menor de 18 años aprovechando la situación de convivencia preexistente«.

Alegatos

Mario Zudaire, fiscal de Cámara, no dudo en ratificar la autoría del acusado. Asimismo, incluyó como agravantes los daños, las amenazas que recibía la víctima, el aprovechamiento de la convivencia preexistente y las circunstancias en que transcurrieron los abusos. Por ese motivo, solicitó una pena de 18 años.

En la misma línea, la Defensora de Niñez y Adolescencia, María Monserrath Bocca, solicitó al tribunal la aplicación de la pena máxima debido al «daño completamente irreparable que se le ha ocasionado a la víctima”.

Cuando el imputado tuvo la palabra, volvió a declararse inocente y solicitó su absolución. No obstante, el tribunal le aplicó la pena de 18 años y ya permanece en el Servicio Penitenciario Provincial.
