Merlo: los artesanos de la villa recurrirán al Tribunal Superior de Justicia

Las tensiones entre los artesanos de la Villa de Merlo y el municipio local se incrementaron luego de que la Asociación que nuclea a estos trabajadores presentara un pedido en la justicia para solicitar trabajar en la Plaza Marqués de Sobremonte. El municipio no autorizó el pedido, y hace días un juez le otorgó a la comuna merlina el poder de decidir si los artesanos pueden vender en ese sector.

La medida proveniente de la Asociación de Artesanos de Merlo fue desestimada por Ramiro Bustos, juez en lo Civil, Comercial, Ambiental, Laboral, Familia y Menores. Sin embargo, estos trabajadores ahora recurrirán al Tribunal Superior de Justicia Provincial, tal como afirmó su abogada, Silvana Rodríguez.

En relación a la resolución judicial, la abogada explicó que desde la justicia no prohibieron la actividad en la plaza, sino que le otorgaron la potestad de decidir al municipio. “No dice que los artesanos no tienen el derecho de estar en ese espacio público, sino que señaló que depende de la Municipalidad que estén o no. Acá no hay un conflicto legal ni se establece ninguna inconstitucionalidad”, señaló Rodríguez.

También recordó que existe una ordenanza que prohíbe la comercialización en la Plaza Marqués de Sobremonte, a excepción de que se trate de un bien público. En este sentido, desde la asociación sostienen que se actividad se enmarca como bien cultural, aunque no tienen la autorización municipal. Rodríguez remarcó que el artículo 75, inciso 22, de la Constitución Nacional indica que la actividad de los artesanos pertenece a la cultura nacional, por lo tanto la establece como bien común.

Tras explicar que el trabajo de los artesanos debe considerarse un derecho constitucional, la abogada manifestó: “Vamos a basar nuestra apelación en que esa potestad del Municipio vulnera derechos constitucionales reconocidos, al no permitir a los artesanos que puedan trabajar en la plaza, más allá de la discriminación que sufren por el hecho de que sí dejaron que la Feria Franca trabaje y ellos no. El objetivo es que revean lo que dice el juez Bustos sobre el poder de policía de la Municipalidad”. Asimismo, explicó que solamente solicitaron el costado este de la plaza, lindante a la calle Presbítero Becerra.

Durante el fin de semana largo, los artesanos instalaron sus puestos en la Plaza y realizaron una serie de reclamos. Asimismo, recolectaron firmas de vecinos y turistas para presentarlas como el aval comunitario para que este sector pueda continuar con su actividad.
