La víctima era hija de uno de los imputados, a quienes denunció en 2019. El juicio oral comenzó este 7 de diciembre.

Dos hombres de Tilisarao fueron condenados a 10 y 17 años de prisión por abusar sexualmente de la hija de uno de ellos. La víctima era menor de edad al momento de los hechos: en 2019 le confesó a su madre que uno de los imputados abusó sexualmente de ella cuando era niña, afirmando que su padre presenció el hecho. Años más tarde, su padre también abusó de ella.

El juicio oral a los imputados comenzó el 7 de diciembre, y ayer miércoles tuvieron lugar los alegatos y el veredicto. En los alegatos el fiscal de Cámara, Néstor Mario Zudaire, solicitó 20 años de prisión para el padre de la niña: lo consideró autor material y penalmente responsable del delito «Abuso sexual con acceso carnal, agravado por el vínculo y por causar un grave daño en la salud mental de la víctima». Para el segundo imputado, amigo del primero, solicitó una condena de 17 años por el delito «Abuso sexual con acceso carnal, agravado por el grave daño causado en la salud mental de la menor».

El tribunal tomó como atenuante del caso la falta de antecedentes penales. Sin embargo, consideraron agravantes la forma en que se cometió el delito, el aprovechamiento de la inmadurez de la víctima y la extensión del daño causado. El Defensor General, José Luis Guiñazú, pidió que se tenga en cuenta el daño irreparable causado a la víctima, ya que aún hoy padece las consecuencias del hecho.

Asimismo, María Elena Aparicio, abogada de la madre de la menor, solicitó a la defensa que aborde lo acontecido desde una perspectiva de género y aconsejó a la defensa técnica a capacitarse en género. Los dos abogados defensores solicitaron la absolución de sus clientes, negando la existencia de pruebas concretas y alegando que la denuncia «fue abstracta» y no hubo comprobación suficiente de los hechos.
