El Tribunal Oral en lo Criminal N° 1 comunicó su decisión tras el proceso. Las pruebas contra los ocho imputados.

Hoy lunes 6 de febrero, el Tribunal Oral en lo Criminal N°1 de Dolores condenó a Máximo Thomsen, Enzo Comelli, Matías Benicelli, Ayrton Viollaz, Blas Cinalli, Luciano, Lucas y Ciro Pertossi como culpables del asesinato de Fernando Báez Sosa, cometido el 18 de enero de 2020 frente a la discoteca Le Brique en Villa Gesell.

Thomsen, Ciro Pertossi, Enzo Comelli, Benicelli, Luciano Pertossi fueron condenados a prisión perpetua por el delito de homicidio doblemente agravado por homicidio premeditación y alevosía en concurso real con lesiones leves.

Ayrton Viollaz, Blas Cinalli y Lucas Pertossi recibieron penas de 15 años de cárcel como partícipes secundarios del mismo delito.

Juan Guarino y T.C, el llamado “rugbier número 11″, menor de edad al momento del hecho, enfrentarán expedientes por falso testimonio tal como pidieron los fiscales acusadores.

Tras la decisión de los magistrados María Claudia Castro, Christian Rabaia y Emiliano Lázzari, el proceso llega a su fin, luego de trece audiencias y 87 testigos, a 3 años y 17 días del hecho.

Los fundamentos del fallo estarán disponibles en la jornada de hoy en la página de la Suprema Corte bonaerense. En todo caso, el equipo de defensores de los acusados ya tiene redactada su apelación que presentará en Casación. El destino de los acusados en la cárcel podrá comenzar a dividirse, tras estar encerrados tres años en pabellones exclusivos para ellos, estipulan fuentes penitenciarias. Podrán ser separados y enviados incluso lejos de sus familias, de acuerdo a los pedidos de cupo que haga la Justicia.
