ORDENARON LA LIBERTAD PARA EL SERENO DE UNA ESCUELA ACUSADO DE HOMICIDIO
El juez Marcos Flores Leyes, a cargo del Juzgado de Garantías N° 3 de la ciudad de San Luis ordenó la inmediata libertad de Pablo Felipe Tapia, el sereno de la Escuela APADIS detenido por el homicidio de Víctor Garrido. La resolución del magistrado se apoyó en el pedido de sobreseimiento que realizó la fiscal de Instrucción N° 4, María del Valle Durán, quien entendió que el acusado actuó en legítima defensa.
Flores Leyes también dictó que Tapia, oriundo de la República de Chile, no podrá abandonar el territorio provincial hasta tanto no se resuelva la instancia de su sobreseimiento definitivo. También solicitó que se notifique a los familiares de la víctima en pos de que aleguen algún tipo de objeción o manifestación al respecto.
El Código Procesal Penal de San Luis impone, cuando existen motivos para sobreseer a una persona, la obligación de comunicar dicho extremo al imputado, a la víctima y al querellante, si hubiere. En un plazo de 5 días, las partes podrán objetar el sobreseimiento y solicitar la continuación de la investigación, y/o requerir que otro fiscal continúe la investigación. El imputado, a su vez, podrá solicitar que se precise la descripción de los hechos del sobreseimiento. (artículo 164)
Lo resuelto por el titular del Juzgado de Garantías se concretó este viernes, en el marco de la continuidad de la audiencia de formulación de cargos luego de que se vencieran los ocho días de prórroga que había solicitado la Defensora Oficial, Nadia Agúndez.
A Tapia, de 31 años, la Fiscalía le había atribuido una calificación penal provisoria por el delito de homicidio simple, que dio inicio a la investigación penal preparatoria. En el marco de esta pesquisa, y luego de recepcionar declaraciones de vecinos, de familiares del acusado, de policías, de testigos del hecho; como así también informes forenses, la fiscal Durán concluyó que de las evidencias recolectadas “surgen claros elementos de la existencia de una causa de justificación siendo esta el de la legítima defensa privilegiada” (artículo N° 34 inc 6 in fine).
Por este motivo, la representante del Ministerio Público Fiscal solicitó en la audiencia el sobreseimiento de Tapia. “El fundamento del privilegio radica en la presunción de peligro para las personas y no contra la propiedad. Lo que debe existir es la ´posibilidad de peligro´ para las personas y la nocturnidad”, explicó Durán.
Y agregó: “nuestro nuevo ordenamiento procesal establece que si el fiscal estima que la investigación proporciona fundamento para someter al juicio al imputado, presentará acusación, de lo contrario deberá solicitar el sobreseimiento y es en este sentido en el que me expreso”.
La investigación
De las declaraciones realizadas se conoció que el acusado y su familia viven en el predio de la Escuela Especial APADIS desde el 2018. Que tienen un contrato que establece que ellos deben cuidar y mantener el lugar a cambio de la vivienda.
Un familiar de Tapia relató que por todos los robos que han sufrido (incluso uno de Garrido anterior a este hecho), era normal que ellos tengan algún elemento que los ayude a defenderse. Que el día del homicidio, vecinos alertaron sobre la presencia de una pareja con un bolso gris, en actitud sospechosa, merodeando el predio.
El 16 de febrero, en horas de la noche, Cristian Garrido Díaz ingresó a la Escuela Especial N° 9 APADIS de la ciudad de San Luis con intenciones de robo y fue atacado con un arma blanca por Tapia, causándole posteriormente la muerte.
De la carta de llamada se desprende que Tapia llamó al 911 a las 23:46 horas manifestando que tenía a una persona herida que había ingresado al lugar. El hombre relató que había escuchado ruidos afuera de su vivienda, por lo que sale y observa a alguien sacando botellas y cajas. Tapia llevaba un cuchillo. Allí comenzó un forcejeo y Garrido cae herido.
De acuerdo al acta de inspección ocular, Garrido ingresó a la propiedad a través de un orificio en el cierre perimetral, estando la totalidad del predio cerrado en perfectas condiciones. En el lugar la iluminación era escasa.
El informe forense determinó que la puñalada de defensa fue perpetrada estando agresor y defendido enfrentados cara a cara y que Tapia presentaba una lesión en la zona abdominal izquierda.
