11 años de prisión por abusar de su hijastra

Franco Natanael Leyes, de 30 años, fue condenado por abusar sexualmente de su hijastra. En ese momento la víctima tenía 12 años.

Este martes Franco Natanael Leyes tuvo que sentarse en el estrado: llegó esperando una sentencia de 18 años por abusar sexualmente de una niña.

El abusador había sido interceptado el día anterior por la Policía de San Luis: fue detenido y le comunicaron que al otro día tendría una audiencia con la Justicia.

El cargo que pesaba contra Leyes era por «Abuso sexual con acceso carnal agravado por la relación de convivencia”, los cuales se dieron de forma reiterada hacia su hijastra. Tras dos breves audiencias, los jueces de la Cámara del Crimen 1 de San Luis concluyeron de forma unánime la culpabilidad del acusado.

En consecuencia, ayer miércoles el tribunal lo sentenció a 11 años de cárcel, a cumplir en la penitenciaría local. Sin embargo, tardaron 8 años en completar el proceso, ya que Leyes había sido denunciado por la madre de la víctima en 2013. El abusador, la niña y su madre convivían en una vivienda del Barrio Eva Perón al momento de los hechos.

El juicio

Cuando inició el debate este martes Leyes aceptó declarar y negó rotundamente las acusaciones. Luego fueron citados los testigos: pasaron por el estrado la víctima, su mamá, el médico forense que revisó a la niña y algunos vecinos que denunciaron conductas inapropiadas de Leyes hacia la víctima.

Maximiliano Bazla Cassina, fiscal a cargo de la causa, solicitó 13 años por el delito por el que Leyes estaba imputado. En cambio, el abogado defensor pidió la absolución del abusador por el principio de la duda.

Algunos de los atenuantes que tomó en cuenta el tribunal para emitir el fallo fueron la falta de antecedentes y la edad del imputado al momento de cometer los abusos. Sin embargo, esta última variable es polémica en tanto Leyes tenía 22 años al momento de cometer los crímenes, 10 más que la niña que los padeció.
