Caso Ariel Rosendo: denegaron la prisión preventiva y elevaron la causa a juicio

El ex senador provincial fue acusado de 3 delitos. Había solicitado pasar la condena en su domicilio por problemas de salud, aunque el pedido fue denegado por la jueza Mirta Ucelay.

La causa contra el ex senador provincial, Ariel Rosendo, sumó otro capítulo: a fines de septiembre del año pasado el legislador perdió sus fueros luego de que lo acusen por «Robo doblemente calificado por efracción y por cometerse en poblado y en banda», «Desobediencia de una orden de la autoridad judicial» y «Violación de las medidas antipandémicas». La justicia le dictó prisión preventiva en aquel momento, aunque la defensa trabajó para sacar a Rosendo de prisión. No pudo.

Rosendo y su defensa habrían alegado que los problemas de salud física y mental que padece quien fuera dirigente de SMATA le impedían permanecer en prisión. Sin embargo, tras negarle la prisión domiciliaria la jueza Ucelay le comunicó que recibiría la atención requerida tras las rejas.

La fiscal de Instrucción 2, Daniela Torres, fue quien solicitó una condena de 10 años para Rosendo. La mañana del 18 de mayo del 2020 vieron al dirigente ingresando al domicilio de SMATA, situado en calle Italia al 420. En ese inmueble convivía con su ex pareja, Ivana Massimino: el ex senador forzó la puerta y tras entrar vació el departamento. Fue confesado incluso por el fletero que contrató.

Aunque pesaba una orden de alejamiento hacia Massimino y su vivienda, Rosendo ingresó al domicilio acompañado por otras 7 personas. En consecuencia, fue acusado de incumplir con la medida judicial, así como de romper con las medidas contra el Covid-19. Será juzgado por la Cámara Penal 2, integrada por los jueces Daniela Estrada, Anibal Astudillo y María Silvia del Castillo de Insúa.
