LA LIBERTAD EN TIEMPOS DE PANDEMIA.

En un mundo ideal en el que todos los derechos humanos son respetados, no serían necesarias regulaciones jurídicas que los garanticen; pero la historia de la humanidad, nos ubicó en la imperiosa obligación de legitimarlos, no sólo en el derecho interno sino también en todo el planeta, pues resulta imperioso que la familia humana que lo habita, tenga herramientas que permitan exigir su irrestricto
respeto por todos los estados parte; entre otros la República Argentina.-
Es en este contexto que el art. 1 de la DECLARACION UNIVERSAL DE DERECHOS HUMANOS, que forma parte del derecho superior argentino (art. 75 inc. 22 de la Constitución Nacional), destaca en su primer párrafo que: “ Todos los seres humanos nacen libres e iguales en dignidad y derechos ”; con lo cual, se está reconociendo que somos intrínsecamente libres, pues así nacemos, por lo que toda restricción a la libertad impuesta sin una orden judicial y que condicione su ejercicio a quien no cometió ningún delito o una grave contravención, no sólo viola la norma citada, sino que contradice la esencia humana.-
Esta valoración, que excede la norma jurídica vigente, nos permite también reflexionar acerca de “cómo”, en mi opinión, debiéramos abordar la pandemia que golpea al mundo, ya que el aislamiento obligatorio, entra en fricción con la naturaleza humana, caracterizada por su LIBERTAD; de allí que dicha medida restrictiva indiscriminadamente dispuesta, termina fracasando y provocando enormes daños personales, familiares y, en general, también gigantescos perjuicios sanitarios, económicos, sociales y laborales a todo el tejido social, afectando inclusive el comercio, nuestro desarrollo y la productividad de la economía argentina; todo lo cual, también mata y nos destruye como seres humanos.-
Durante gran parte del 2020 estuvimos aislados, encerrados, alejados de nuestros afectos y en general, privados de nuestra libertad; es decir, apartados de nuestra esencia humana y el resultado no sólo fue humanamente devastador, sino que ahora se nos dice que viene la segunda ola y se propone una receta similar, con lo cual sabemos el desenlace en el marco de un lento proceso de vacunación, que tampoco garantiza inmunidad frente al virus.-
Es por ello, que frente a la magnitud de la crisis debemos proteger la esencia humana y no contrariarla; creo, debemos apelar a la responsabilidad social de los seres humanos que, cumpliendo con los protocolos establecidos, podamos desarrollarnos como seres humanos intrínsecamente libres.-
